BUDGETARY PROCEDURES: Provides for legislative development of budget 1 AN ACT 2To amend and reenact R.S. 39:33(A)(1) and to enact R.S. 39:33.3 and 51(G), relative to 3 operating budget development; to provide for review and development of budget 4 documents by committees of the House of Representatives; to provide for the 5 development of an appropriation bill for the ordinary expenses of state government; 6 and to provide for related matters. 7Be it enacted by the Legislature of Louisiana: 8 Section 1. R.S. 39:33(A)(1) is hereby amended and reenacted and R.S. 39:33.3 and 951(G) are hereby enacted to read as follows: 10 §33. Agency budget request; time of submission; standing committees 11 A.(1) The head of each budget unit or the Board of Regents as provided by 12 law, on a date specified by the commissioner of administration which date shall not 13 be later than the fifteenth day of November in each year, shall submit its budget 14 request to the governor on the forms and in the manner prescribed and accompanied 15 by such other data as may be required, together with such additional information as 16 the governor may request. The budget requests or statements of various budget 17 units, any additional information as the governor may request, and any budget 18 statement prepared by the commissioner of administration pursuant to Subsection B 19 of this Section, shall be submitted to the speaker of the House of Representatives on Page 1 of 4 CODING: Words in struck through type are deletions from existing law; words underscored are additions. Review of budget requests by House committees; development of 5 Appropriations Committee Recommendation for the Executive Budget 6 A. Upon receipt of a budget request or statement pursuant to R.S. 39:33(A), 7 the speaker of the House of Representatives shall assign the request or statement to 8 the appropriate standing committees of the House of Representatives which shall 9 review the budget requests and statements assigned to them to make 10 recommendations on the funding levels contained in the budget request. The budget 11 requests and statements shall be assigned, if practicable, to the standing committees 12 which have usual jurisdiction over the affairs of the budget units for which the 13 request or statement is submitted. 14 B. The standing committees shall notify the head of each budget unit whose 15 budget is assigned to the committee of a tentative schedule of hearings. In addition, 16 the committees may request any other information which a standing committee in 17 its discretion determines is necessary to perform its duties. 18 C. The appropriate standing committees shall provide a report to the House 19 Committee on Appropriations on each budget unit assigned to the committee. The 20 report shall include, at a minimum, a recommended level of funding and the means 21 of finance for the budget unit. The recommended level of funding shall include 22 recommended expenditures for each program in the budget unit and the total means 23 of finance for the budget unit. 24 D. The standing subcommittees of the House Committee on Appropriations 25 shall review the standing committee reports on the budget units assigned to the 26 standing subcommittee by House Rule or referred to the subcommittee by the 27 chairman of the House Committee on Appropriations and shall present a 28 recommended level of funding for each budget unit to the House Committee on 29 Appropriations. The standing subcommittees shall report the recommended levels of 4 funding to the House Committee on Appropriations for review, modification, and 5 approval of the full committee for incorporation into the Appropriations Committee 6 Recommendation for the Executive Budget. 7 F. The Appropriations Committee Recommendation for the Executive 8 Budget shall include recommendations for each department and budget unit by 9 means of financing and recommended expenditures by program. The Appropriations 10 Committee Recommendation for the Executive Budget shall include 11 recommendations for appropriations from the state general fund and dedicated funds 12 which shall not exceed the official forecast of the Revenue Estimating Conference 13 and which shall not exceed the expenditure limit for the ensuing fiscal year. 14 G. All agencies, boards, commissions, and departments of the state, whether 15 budget or nonbudget units, and of any of its political subdivisions, shall assist the 16 standing committees, the standing subcommittees, and the House Committee on 17 Appropriations in their work and shall furnish such information, reports, aid, 18 services, and assistance as may be requested by the committees or subcommittees, 19 all without any cost or charge of any nature to the committees and subcommittees. 20 * * * 21 §51. The House Committee on Appropriations shall cause an Appropriations 24 Committee Recommended Appropriation Bill for the ordinary operating expenses 25 of government to be introduced which shall be in conformity with the 26 recommendations for appropriations contained in the Appropriations Committee 27 Recommendation for the Executive Budget as provided by R.S. 39:33.3. Present law requires the head of each budget unit or the Board of Regents to submit its budget request to the governor together with such additional information as the governor may request. The budget request is due on a date specified, but no later than November 15 of each year. Proposed law provides a procedure for the review of budget requests and development of a Appropriations Committee Recommendation of the Executive Budget and an Appropriations Committee Recommended Appropriation Bill as follows: (1)The budget requests are be submitted to the speaker of the House at the same time such information is submitted to the governor under present law. The speaker shall assign the budget request to the appropriate standing committee. (2)The standing committees shall meet on the budget units referred to them and submit recommended levels of funding for each budget unit by program and means of financing to the House Committee on Appropriations. (3)The standing subcommittees of the House Committee on Appropriations shall meet on the budget units under their jurisdiction as provided by House Rule and determine a recommended level of funding for each budget unit. (4)The standing subcommittees shall report the recommended levels of funding to the House Committee on Appropriations for review, modification, and approval of the full committee for incorporation into the Appropriations Committee Recommendation for the Executive Budget. Recommended appropriations shall not exceed the amount of the official forecast or the expenditure limit. (5)The House Appropriations Committee shall cause to be introduced an Appropriations Committee Recommended Appropriation Bill which shall be in conformity with the recommendations for appropriations contained in the Appropriations Committee Recommendation for the Executive Budget.
