TEACHERS:  Prohibits teachers first employed by a La. public school on or after July 1,
2015, from being eligible to acquire tenure and requires annual employment
contracts for such teachers
1	AN ACT
2To enact R.S. 17:413.1 and 442(A)(1)(c), relative to certain teachers first employed on or
3 after July 1, 2015; to provide relative to employment of such teachers; to provide
4 relative to termination of employment of such teachers; to provide relative to tenure
5 for such teachers to provide for an effective date; and to provide for related matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 17:413.1 and 442(A)(1)(c) are hereby amended and reenacted to read
8as follows: 
9 §413.1.  Teachers hired on or after July 1, 2015
10	Notwithstanding any provision of law to the contrary, any teacher whose first
11 employment as a public school teacher in Louisiana occurs on or after July 1, 2015,
12 shall be employed by annual contract with the local school board.  Each contract
13 shall be valid for one year and the terms and renewal of such contract shall be at the
14 discretion of the local school superintendent.  Each contract shall contain a
15 termination clause and a contract may only be terminated after notice and a hearing
16 conducted in accordance with R.S. 17:443(A).

1	(c)  Any teacher whose first employment as a public school teacher in
2 Louisiana occurs on or after July 1, 2015, shall not be eligible to acquire tenure.

4 Section 2.  This Act shall become effective upon signature by the governor or, if not
5signed by the governor, upon expiration of the time for bills to become law without signature
6by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.  If
7vetoed by the governor and subsequently approved by the legislature, this Act shall become
8effective on the day following such approval.

Abstract:  Prohibits teachers whose first employment as a public school teacher in
Louisiana occurs on or after July 1, 2015, from being eligible to acquire tenure;
further requires the employment of such teachers to be by annual contract.
Present law provides relative to the employment and rights of K-12 teachers.  Proposed law
requires that for teachers whose first employment as a public school teacher in Louisiana
occurs on or after July 1, 2015, employment shall be by year-to-year contract.  Further
provides that the terms and renewal of such contract shall be at the discretion of the local
school superintendent.  Requires that each contract contain a termination clause.  Provides
that a contract may only be terminated after notice and a hearing conducted in accordance
with present law (R.S. 17:443(A)) governing disciplinary action against nontenured teachers.
Present law provides that for teachers hired on or after July 1, 2012, tenure may only be
acquired by attaining a "highly effective" rating pursuant to present law for five years within
a six-year period.  Proposed law provides that any teacher whose first employment as a
public school teacher in Louisiana occurs on or after July 1, 2015, shall not be eligible to
acquire tenure.
Effective upon signature of governor or lapse of time for gubernatorial action.
