HLS 15RS-476 ORIGINAL 2015 Regular Session HOUSE BILL NO. 529 BY REPRESENTATIVE MILLER LEVEES/BDS & DISTRICTS: Provides relative to the Lafourche Basin Levee District 1 AN ACT 2To amend and reenact R.S. 38:334(A), relative to expenditures of taxes collected by the 3 Lafourche Basin Levee District from property in St. Charles Parish located west of 4 the Mississippi River; to provide that certain provisions of law relating to 5 expenditures of taxes collected by the Lafourche Basin Levee District from property 6 in St. Charles Parish located west of the Mississippi River shall not apply in certain 7 circumstances; and to provide for related matters. 8 Notice of intention to introduce this Act has been published 9 as provided by Article III, Section 13 of the Constitution of 10 Louisiana. 11Be it enacted by the Legislature of Louisiana: 12 Section 1. R.S. 38:334(A) is hereby amended and reenacted to read as follows: 13 ยง334. Revenue utilization; Lafourche Basin Levee District 14 A.(1) Of all the taxes collected by the Lafourche Basin Levee District from 15 property located within St. Charles Parish located west of the Mississippi River, not 16 less than fifty-seven percent of the tax monies shall be expended for the purposes of 17 levee construction, levee maintenance, and other flood control and drainage works 18 within that parish. These expenditures shall be in cash or in-kind services as 19 determined by the parish governing body. When such funds are expended within St. 20 Charles Parish, in-kind services shall not exceed fifty percent of such expenditures. HLS 15RS-476 ORIGINAL HB NO. 529 1 Expenditures shall be certified as received by the parish's governing body at the end 2 of each fiscal year. 3 (2) The provisions of this Subsection shall not apply during any tax year in 4 which the Lafourche Basin Levee District maintains the St. Charles Parish West 5 Bank Hurricane Protection Levee System, including the West Bank and general 6 vicinity, Western Tie-In, Davis Pond Levee, Willowridge Levee, Ellington Levee, 7 Magnolia Ridge Levee, and Sunset Drainage District Levee, as a whole or as each 8 section is transferred to the Lafourche Basin Levee District for maintenance, 9 operation, and control, subject to any amendments made by the state of Louisiana. 10 * * * DIGEST The digest printed below was prepared by House Legislative Services. [R.S. 1:13(B) and 24:177(E)] HB 529 Original 2015 Regular Session Miller Abstract: Provides that certain provisions relating to the distribution of taxes collected by the Lafourche Basin Levee District from property located within St. Charles Parish shall not apply during any tax year in which the Lafourche Basin Levee District maintains the St. Charles Parish West Bank Hurricane Protection Levee System. Present law provides that taxes collected by the Lafourche Basin Levee District from property located within St. Charles Parish located west of the Mississippi River, not less than 57% of the tax monies are to be expended for the purposes of levee construction, levee maintenance, and other flood control and drainage works within St. Charles Parish. These expenditures are to be in cash or in-kind services as determined by the parish governing body. When such funds are expended within St. Charles Parish, in-kind services shall not exceed 50% of such expenditures. Proposed law retains present law, but specifies that present law shall not apply during any tax year in which the Lafourche Basin Levee District maintains the St. Charles Parish West Bank Hurricane Protection Levee System, as a whole or as each section is transferred to the Lafourche Basin Levee District for maintenance, operation, and control, subject to any amendments made by the state of La.
