RÉSUMÉ DIGEST ACT 353 (HB 717) 2015 Regular Session Smith New law prohibits a parish or municipality from enacting ordinances that provide for any of the following actions against a person for contacting law enforcement or other emergency officials to request assistance with a domestic abuse incident or other crime that involves property loss, personal injury, or death or that the requestor had a reasonable belief would result in such loss, injury, or death. (1)Impose penalties on a victim of domestic abuse or other crimes who requests assistance with such an incident. (2)Impose penalties on a property owner because a tenant or person acting on his behalf requests assistance with such an incident. (3)Authorize the eviction of a tenant or the termination or suspension of a rental agreement because the tenant or someone acting on his behalf requests assistance with such an incident. New law provides that if a local government takes an action against a person pursuant to an ordinance that violates new law, the person may bring a civil action against the local government; specifies available remedies in such an action. New law provides for its prospective application only and that it does not affect any ordinance adopted prior to June 29, 2015. Effective upon signature of governor (June 29, 2015).
