BY REPRESENTATIVES JONES, BROWN, GISCLAIR, GUINN, HILL, HOWARD,
LEOPOLD, RICHARD, AND ST. GERMAIN
LEVEES/BDS & DISTRICTS:  Provides relative to the powers and duties of the St. Mary
Levee District
1	AN ACT
2To enact R.S. 38:329.3(J) and (K), relative to the powers and duties of the St. Mary Levee
3 District; to transfer all rights and obligations from contractual agreements with the
4 United States Department of the Army relating to levee, floodwall, and floodgate
5 property situated within St. Mary Parish to the St. Mary Levee District; to provide
6 the authority for the St. Mary Levee District Board of Commissioners to serve as the
7 nonfederal, local sponsor for all federal levee, floodwall, and flood control structures
8 within St. Mary Parish; and to provide for related matters.
9	Notice of intention to introduce this Act has been published
10	as provided by Article III, Section 13 of the Constitution of
11	Louisiana.
12Be it enacted by the Legislature of Louisiana:
13 Section 1.  R.S. 38:329.3(J) and (K) are hereby enacted to read as follows:
14 ยง329.3.  St. Mary Levee District Board of Commissioners; powers and duties

16	J.(1)  All rights and obligations, including but not limited to those belonging
17 to the Town of Berwick, the City of Morgan City, and the Parish of St. Mary, arising
18 from any and all contractual agreements, including "Acts of Assurances" and
19 "Agreements for Local Cooperation", with the United States Department of the

1 Army and relating to levee, floodwall, and floodgate property, exclusive of drainage
2 pumps, situated within St. Mary Parish, are hereby transferred to the St. Mary Levee
3 District.
4	(2)  The transfer of all rights and obligations set forth in this Subsection shall
5 occur by operation of law and shall be complete without the necessity of any other
6 act, instrument, or deed.
7	K.  The board shall have the authority to serve as the sole nonfederal, local
8 sponsor for all federal levees, floodwalls, and flood control structures situated within
9 St. Mary Parish.

Abstract:  Transfers all rights and obligations of Berwick, Morgan City, St. Mary Parish,
and any other body arising from contractual agreements with the U.S. Dept. of the
Army and relating to levee, floodwall, and floodgate property in St. Mary Parish to
the St. Mary Levee District and provides the authority for the St. Mary Levee District
to be designated as the sole nonfederal, local sponsor for all federal levees,
floodwalls, and flood control structures in St. Mary Parish.
Proposed law transfers all rights and obligations including but not limited to those belonging
to the Town of Berwick, the City of Morgan City, and the Parish of St. Mary arising from
any and all contractual agreements with the U.S. Dept. of the Army and relating to levee,
floodwall, and floodgate property, exclusive of drainage pumps, situated within St. Mary
Parish, to the St. Mary Levee District.
Proposed law provides the authority for the board of commissioners for the St. Mary Parish
Levee District to serve as the nonfederal, local sponsor for all federal levees, floodwalls, and
flood control structures situated in St. Mary Parish.
