HLS 15RS-428 ENGROSSED 2015 Regular Session HOUSE CONCURRENT RESOL UTION NO. 1 BY REPRESENTATIVE DOVE COASTAL RESOURCES: Approves the 2015-2016 annual plan for integrated coastal protection and restoration 1 A CONCURRENT RESOL UTION 2To approve the annual integrated coastal protection plan for Fiscal Year 2015-2016 as 3 adopted by the Coastal Protection and Restoration Authority. 4 WHEREAS, R.S. 49:214.5.1 et seq. creates the Coastal Protection and Restoration 5Authority Board to represent the state's position in policy relative to the protection, 6conservation, enhancement, and restoration of the coastal area of the state through oversight 7of integrated coastal protection projects and programs; and 8 WHEREAS, R.S. 49:214.5.1 et seq. provides that the board shall develop, coordinate, 9make reports on, and provide oversight for the comprehensive coastal protection annual 10plan; and 11 WHEREAS, R.S. 49:214.5.1 et seq. provides for the creation, duties, and 12responsibilities of the Coastal Protection and Restoration Authority as the implementation 13and enforcement arm of the board and through its offices and officers shall be responsible 14for the implementation and enforcement of the annual state integrated coastal protection 15plan; and 16 WHEREAS, the annual state integrated coastal protection plan represents the state 17policy for protecting, conserving, and restoring Louisiana's coastal area through the 18construction and management of integrated coastal protection projects and programs, 19including coastal protection and restoration projects and hurricane protection projects, which 20are projects that may require, without limitation, funding for associated measures such as the 21beneficial use of dredged material, rehabilitation and repair of state restoration projects, Page 1 of 2 HLS 15RS-428 ENGROSSED HCR NO. 1 1environmental and regulatory compliance, acquisition of land easements, right-of-ways, 2relocations and disposal areas (LERRDS), maintenance programs, conservation and 3restoration partnerships, reserve fund contingencies, and other innovative programs, 4provided that such funding for associated measures shall be allocated to the projects based 5on priority status as identified by the annual state integrated coastal protection plan in order 6to more effectively respond to the ever-changing coastal crisis; and 7 WHEREAS, as required under the provisions of R.S. 49:214.5.3, the annual state 8integrated coastal protection plan adopted by the authority must be submitted to the Senate 9Committee on Natural Resources and the House Committee on Natural Resources and 10Environment and the Senate Committee on Transportation, Highways and Public Works and 11the House Committee on Transportation, Highways and Public Works, on or before the 12fifteenth day of the regular legislative session of each year; and 13 WHEREAS, these committees must provide guidance for and approval of the annual 14state integrated coastal protection plan; and 15 WHEREAS, the annual state integrated coastal protection plan shall become 16effective and shall be implemented upon approval of the annual plan by a majority of both 17houses of the legislature, or if a majority of both houses of the legislature fails to disapprove 18the annual state integrated coastal protection plan by July 1, 2015, it shall become 19immediately effective and implemented. 20 THEREFORE, BE IT RESOLVED that the Legislature of Louisiana does hereby 21approve the Fiscal Year 2015-2016 annual plan for integrated coastal protection, as adopted 22by the Coastal Protection and Restoration Authority. 23 BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the 24chairman of the Coastal Protection and Restoration Authority.
