State Law Institute to study the issue of restitution in delinquency cases and to report its findings to the La. Legislature 1 A CONCURRENT RESOL UTION 2To authorize and direct the Children's Code Committee of the Louisiana State Law Institute 3 to study the issue of restitution in delinquency cases and to report its findings, 4 including any recommendations for legislative changes, to the Legislature of 5 Louisiana prior to the convening of the 2016 Regular Session. 6 WHEREAS, an effective juvenile justice system should incorporate mechanisms to 7promote the reparation of harm inflicted upon victims and communities when a child has 8committed a delinquent act; and 9 WHEREAS, restitution can be an important part of a restorative process of repairing 10harm and making victims whole; and 11 WHEREAS, parental engagement is critical in promoting strong outcomes for 12children in the juvenile justice system, including desistence from further delinquency; and 13 WHEREAS, recognizing the positive role that restitution can play in a high- 14functioning juvenile justice system, the legislature wishes to study the possibility of 15amending the Children's Code to provide for the possibility of parental restitution in certain 16delinquency cases; and 17 WHEREAS, the law governing the prosecution and imposition of consequences for 18delinquent acts is complex, and any changes to the law would benefit from careful and 19comprehensive study, taking into account the needs of victims, the rights of parents and 20children, and the important public interests that underlie the juvenile justice system, 21including protecting due process, preserving families, and promoting child well-being. Page 1 of 2 HLS 15RS-2161 ORIGINAL HCR NO. 117 1 THEREFORE, BE IT RESOLVED that the Legislature of Louisiana does hereby 2authorize and direct the Children's Code Committee of the Louisiana State Law Institute to 3study the issue of restitution in delinquency cases, including the issue of parental restitution 4in certain delinquency cases, and to report its findings to the Legislature of Louisiana, 5including any recommendations for legislative changes as are appropriate. 6 BE IT FURTHER RESOLVED that the report be submitted to the Louisiana 7Legislature prior to the convening of the 2016 Regular Session of the Legislature of 8Louisiana. 9 BE IT FURTHER RESOLVED that the Louisiana State Law Institute work in 10conjunction with and obtain input from all stakeholders deemed appropriate by the 11Children's Code Committee. 12 BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the 13Louisiana State Law Institute.
