School Boards Association to develop and implement an appeals process for audits of privatized positions 1 A CONCURRENT RESOL UTION 2To request the Louisiana School Employees' Retirement System and the Louisiana School 3 Boards Association to jointly develop and implement an appeals process for disputes 4 arising from audits performed by the retirement system relative to privatized 5 positions and to report the findings and details of the appeals process to the 6 legislature by December 1, 2015. 7 WHEREAS, the Louisiana School Employees' Retirement System is required by law 8to collect from employers that portion of the unfunded accrued liability attributable to 9employees whose positions are eliminated through privatization, outsourcing, contracting 10for service with a private employer, or any other means; and 11 WHEREAS, school districts face changing work environments and desire more 12certainty regarding their obligations toward the unfunded accrued liability attributable to 13such eliminated positions; and 14 WHEREAS, the legislature has a constitutional obligation to maintain the actuarial 15soundness of the state's retirement systems and therefore has a vested interest in ensuring 16proper execution of its retirement laws. 17 THEREFORE, BE IT RESOLVED that the Legislature of Louisiana does hereby 18request the Louisiana School Employees' Retirement System and the Louisiana School 19Boards Association to jointly develop and implement an appeals process for disputes arising 20from audits performed by the retirement system relative to privatized positions and to report 21such findings and procedures to the legislature by December 1, 2015.
