ENROLLED 2015 Regular Session HOUSE CONCURRENT RESOL UTION NO. 130 BY REPRESENTATIVE PRICE A CONCURRENT RESOL UTION To request the Louisiana School Employees' Retirement System and the Louisiana School Boards Association to jointly develop and implement an appeals process for disputes arising from audits performed by the retirement system relative to privatized positions and to report the findings and details of the appeals process to the legislature by December 1, 2015. WHEREAS, the Board of Trustees of the Louisiana School Employees' Retirement System is charged with the fiduciary duty of administering all laws relative to the system including R.S. 11:1195.1 and 1195.2; and WHEREAS, the Louisiana School Employees' Retirement System is required by law to collect from employers that portion of the unfunded accrued liability attributable to employees whose positions are eliminated through privatization, outsourcing, contracting for service with a private employer, or any other means; and WHEREAS, school districts face changing work environments and desire more certainty regarding their obligations toward the unfunded accrued liability attributable to such eliminated positions; and WHEREAS, the legislature has a constitutional obligation to maintain the actuarial soundness of the state's retirement systems and therefore has a vested interest in ensuring proper execution of its retirement laws. THEREFORE, BE IT RESOLVED that the Legislature of Louisiana does hereby request the Louisiana School Employees' Retirement System and the Louisiana School Boards Association to jointly develop a process for appealing to the board of trustees any disputes arising from audits performed by the retirement system staff relative to privatized positions and to report such findings and procedures to the legislature by December 1, 2015.
