HLS 15RS-1052 ORIGINAL 2015 Regular Session HOUSE CONCURRENT RESOL UTION NO. 133 BY REPRESENTATIVE SCHEXNAYDER HEALTH/SPINAL CORD DYS: Urges and requests the Traumatic Head and Spinal Cord Injury Trust Fund Advisory Board to study and make recommendations for providing services to persons with injuries arising from sudden internal medical conditions 1 A CONCURRENT RESOL UTION 2To urge and request the Traumatic Head and Spinal Cord Injury Trust Fund Advisory Board 3 to study and make recommendations for policy and procedural changes, including 4 necessary legislation, to expand its services to persons with spinal cord injuries 5 arising from sudden internal medical conditions not later than sixty days prior to the 6 beginning of the 2016 Regular Session of the Legislature of Louisiana. 7 WHEREAS, R.S. 46:2631 et seq. provides for the development of a rehabilitation 8program for persons disabled by traumatic head and spinal cord injuries through the 9establishment of the Traumatic Head and Spinal Cord Injury Trust Fund to be funded by 10additional fees imposed on motor vehicle violations in this state for the offenses of driving 11under the influence, reckless operation, and speeding; and 12 WHEREAS, the purpose of the Traumatic Head and Spinal Cord Injury Trust Fund 13is to provide Louisiana citizens who survive traumatic head or spinal cord injuries a source 14of funds for services enabling them to return to a reasonable level of functioning and 15independent living in their communities; and 16 WHEREAS, spinal cord injury is defined, for the purposes of the trust fund, as an 17insult to the spinal cord, not of a degenerative or congenital nature, but caused by an external 18physical force resulting in paraplegia or quadriplegia; and Page 1 of 2 HLS 15RS-1052 ORIGINAL HCR NO. 133 1 WHEREAS, an injury to the spinal cord resulting in a change, either temporary or 2permanent, in the spinal cord's normal motor, sensory, or autonomic function may be the 3effect of an acute internal medical event such as a brainstem aneurysm; and 4 WHEREAS, individuals with spinal cord injuries caused by sudden internal medical 5conditions are also in need of services enabling them to return to a reasonable level of 6functioning and independent living in their communities; and 7 WHEREAS, current statutory authority establishing the Traumatic Head and Spinal 8Cord Injury Trust Fund precludes these individuals from receiving assistance through the 9trust fund; and 10 WHEREAS, policy and procedural changes, including legislation, will be necessary 11to provide essential services through the trust fund to individuals with spinal cord injuries 12caused by sudden internal medical conditions. 13 THEREFORE, BE IT RESOLVED that the Legislature of Louisiana does hereby 14urge and request the Traumatic Head and Spinal Cord Injury Trust Fund Advisory Board to 15study and determine the policy and procedural changes, including necessary legislation, 16required to expand its services to persons with spinal cord injuries arising from sudden 17internal medical conditions. 18 BE IT FURTHER RESOLVED that the Traumatic Head and Spinal Cord Injury 19Trust Fund Advisory Board shall submit a written report of its findings and 20recommendations to the legislature not later than sixty days prior to the beginning of the 212016 Regular Session of the Legislature of Louisiana. 22 BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the 23chairman of the Traumatic Head and Spinal Cord Injury Trust Fund Advisory Board.
