HLS 15RS-494 ORIGINAL 2015 Regular Session HOUSE CONCURRENT RESOL UTION NO. 183 BY REPRESENTATIVE HOFFMANN COMMERCE: Requests the office of state fire marshal to study the classifications, commercial implications, and inspection requirements relative to potable water boilers and other boilers as defined in Title 55, Part 5 of the Louisiana Administrative Code 1 A CONCURRENT RESOL UTION 2To urge and request the office of state fire marshal to study and make recommendations with 3 respect to the classifications, commercial implications, and inspection requirements 4 of potable water boilers and other boilers as defined in Title 55, Part 5 of the 5 Louisiana Administrative Code. 6 WHEREAS, LAC 55:V:5003 defines a potable water boiler as "a vessel in which 7water is heated and withdrawn for use external to itself at pressures not exceeding 160 psig 8and temperatures not exceeding 210° F"; and 9 WHEREAS, a potable water boiler as defined in LAC 55:V:5003 includes "hot water 10heaters (fired and electric), supplying potable hot water, 50 gallons and over in capacity; coil 11water heaters and fired jacketed kettles"; and 12 WHEREAS, the inclusion of certain hot water heaters within the definition of potable 13water boiler may have implications on the plumbing industry concerning the licensing 14requirements for the installation and inspection of such a potable water boiler or hot water 15heater; and 16 WHEREAS, the inclusion of certain hot water heaters within the definition of potable 17water boiler may also implicate the consumer's duty to provide inspection for such a 18commercial hot water heater defined by law as a potable water boiler; and Page 1 of 3 HLS 15RS-494 ORIGINAL HCR NO. 183 1 WHEREAS, Title 55, Part 5 of the Louisiana Administrative Code specifies 2requirements for installation and inspection relative to the commercial use of potable water 3boilers, hot water heaters, and other devices defined as boilers; and 4 WHEREAS, LAC 55:V:5007 provides that "upon completion of installation, all 5boilers shall be inspected by an inspector commissioned to inspect boilers in this state"; and 6 WHEREAS, the rules and regulations made applicable to inspectors commissioned 7to inspect boilers in this state are under the purview of the office of state fire marshal, as are 8the provisions of law made applicable to all boilers as defined in Title 55, Part 5 of the 9Louisiana Administrative Code; and 10 WHEREAS, it reasonably follows that the office of state marshal is the appropriate 11agency to study and make recommendations relative to boilers in this state, and the findings 12and recommendations from such a study may help to determine revisions necessary to 13properly govern any potable water boiler, hot water heater, or other device defined as a 14boiler in Title 55, Part 5 of the Louisiana Administrative Code. 15 THEREFORE, BE IT RESOLVED that the Legislature of Louisiana does hereby 16urge and request the office of state fire marshal to study and make recommendations with 17respect to the classifications, commercial implications, and inspection requirements of 18potable water boilers and other boilers as defined in Title 55, Part 5 of the Louisiana 19Administrative Code. 20 BE IT FURTHER RESOLVED that the office of state fire marshal may also evaluate 21consensus standards and may make maintenance recommendations with respect to its 22findings relative to any boiler as defined in Title 55, Part 5 of the Louisiana Administrative 23Code. 24 BE IT FURTHER RESOLVED that the office of state fire marshal shall report its 25findings and recommendations to the House Committee on Commerce and Senate 26Committee on Commerce, Consumer Protection, and International Affairs on or before 27February 15, 2016. 28 BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to Chief 29H.
