HLS 15RS-3424 ORIGINAL 2015 Regular Session HOUSE CONCURRENT RESOL UTION NO. 184 BY REPRESENTATIVE EDWARDS LEASES: Directs the Louisiana State Law Institute to study and make recommendations to the legislature regarding the Louisiana Lease of Movables Act 1 A CONCURRENT RESOL UTION 2To authorize and direct the Louisiana State Law Institute to study and make 3 recommendations to the Louisiana Legislature regarding the Louisiana Lease of 4 Movables Act and related laws, including but not limited to changes in the law 5 governing such transactions and the need to update the law to reflect present-day 6 commercial and consumer practices. 7 WHEREAS, Part I of Chapter 2 of Code Title IX of Code Book III of Title 9 of the 8Louisiana Revised Statutes contains the Louisiana Lease of Movables Act; and 9 WHEREAS, the general purpose that underlies the Louisiana Lease of Movables Act 10is to encourage and foster the leasing and financing of movable property to individuals and 11businesses in order to promote economic development and growth; and 12 WHEREAS, as commercial transactions have become more complex and the focus 13on consumer protection has become more prominent, various states have taken steps to 14update or improve their laws governing the leasing of equipment and similar movables; and 15 WHEREAS, the Louisiana Lease of Movables Act was enacted in 1985, and, except 16for a number of narrow amendments, has not been reviewed broadly in nearly thirty years; 17and 18 WHEREAS, the legislature should be fully informed as to the continued 19effectiveness of the Louisiana Lease of Movables Act and whether updates, modifications, 20and improvements should be made in order to better align the law in this area with the 21commercial and consumer practices of the marketplace. Page 1 of 2 HLS 15RS-3424 ORIGINAL HCR NO. 184 1 THEREFORE, BE IT RESOLVED that the Legislature of Louisiana does hereby 2authorize and direct the Louisiana State Law Institute to study the legal issues surrounding 3the Louisiana Lease of Movables Act and any related laws, and to report and recommend to 4the Louisiana Legislature any need for the revision of current law. 5 BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the 6director of the Louisiana State Law Institute.
