ENROLLED 2015 Regular Session HOUSE CONCURRENT RESOL UTION NO. 220 BY REPRESENTATIVES CROMER AND KLECKLEY A CONCURRENT RESOL UTION To urge and request the House Committee on Insurance and the Senate Committee on Insurance, in consultation with the Department of Insurance and insurance industry representatives, to study the insurance premium tax and retaliatory tax issues affecting insurance companies doing business in the state of Louisiana. WHEREAS, the state of Louisiana has one of the highest premium tax rates for insurance companies in the country; and WHEREAS, the insurance companies doing business in our state are subject to retaliatory taxes as a result of the premium tax structure in the Louisiana Insurance Code; and WHEREAS, it is important that the regulatory and statutory framework for premium taxes and retaliatory taxes be reviewed to determine if it is fair and equitable. THEREFORE, BE IT RESOLVED that the Legislature of Louisiana does hereby urge and request the House Committee on Insurance and the Senate Committee on Insurance, in consultation with the Department of Insurance and insurance industry representatives, to study the regulatory and statutory framework for premium taxes and retaliatory taxes to determine if such framework is fair and equitable to the insurance industry and to the state of Louisiana. BE IT FURTHER RESOLVED that such a study include a review of the laws of other states and address whether the enactment of legislation by the Legislature of Louisiana should be considered. BE IT FURTHER RESOLVED that the House Committee on Insurance and the Senate Committee on Insurance may submit the findings from the study in the form of a report to the Louisiana Legislature on or before December 31, 2015.
