GERMAIN, STOKES, TALBOT, THIBAUT, THIERRY, ALFRED WILLIAMS, PATRICK WILLIAMS, WILLMOTT, AND WOODRUFF LEGISLATIVE AFFAIRS: Expresses intention and support of the House of Representatives to meet in veto session if the governor vetoes any appropriation or funding the legislature has provided for healthcare and higher education 1 A RESOLUTION 2To express the intention and support of the House of Representatives to meet in a veto 3 session if the governor vetoes any appropriation or funding the legislature has 4 provided for healthcare and higher education. 5 WHEREAS, Article III, Section 16 of the Constitution of Louisiana provides that no 6money shall be withdrawn from the state treasury except through specific appropriation, and 7no appropriation shall be made for longer than one year; and 8 WHEREAS, the current Fiscal Year ends on June 30, 2015, and the new Fiscal Year 9begins on July 1, 2015; and 10 WHEREAS, this year is the last year of the term of office of the current governor; 11and 12 WHEREAS, Article III, Section 16 of the Constitution of Louisiana provides that 13except for the expenses of the legislature, a bill appropriating money in an extraordinary Page 1 of 3 HLS 15RS-4279 ORIGINAL HR NO. 183 1session convened after the final adjournment of the regular session in the last year of the 2term of office of a governor shall require the favorable vote of three-fourths of the elected 3members of each house; and 4 WHEREAS, it is imperative for the maintenance of vital services for Louisianians 5and maintenance of critical regulation functions and other functions and duties of state 6government to maintain the heath, safety, welfare, education, and future of Louisianians that 7an operating budget for state government and appropriate funding for the operating budget 8be enacted in a timely manner; and 9 WHEREAS, the people of Louisiana have entrusted and empowered the Legislature 10of Louisiana to generally shape the policy of the state through control of the purse strings, 11specifically through the amendment and enactment of the operating and capital outlay 12budgets and the power to raise revenue, and the constitution vests the authority for 13appropriation of state monies and the power to raise certain revenues solely with the 14legislature; and 15 WHEREAS, Article III, Section 18 of the Constitution of Louisiana requires the 16legislature to meet in veto session in the state capital at noon on the fortieth day following 17final adjournment of the most recent session, to consider all bills vetoed by the governor, 18unless a majority of the elected members of either house declare in writing that a veto 19session is unnecessary; and 20 WHEREAS, Article III, Section 18 of the Constitution of Louisiana provides that a 21bill vetoed and subsequently approved by two-thirds of the elected members of each house 22shall become law. 23 THEREFORE, BE IT RESOLVED that the House of Representatives of the 24Legislature of Louisiana does hereby express its intention and support to meet in veto 25session if the governor vetoes any appropriation or funding the legislature has provided for 26healthcare and higher education.
