TUITION.  Constitutional amendment to authorize the postsecondary education management
boards to establish tuition and fee amounts charged by institutions under their supervision
and management. (2/3-CA13sl(A))
1	A JOINT RESOLUTION
2 Proposing to add Article VIII, Section 7.2 of the Constitution of Louisiana, relative to
3 postsecondary education; to authorize certain postsecondary education management
4 boards to establish the tuition and mandatory fee amounts charged by the institutions
5 under their supervision and management; to authorize certain postsecondary
6 education management boards to establish certain admissions standards; and to
7 specify an election for submission of the proposition to electors and provide a ballot
8 proposition.
9 Section 1. Be it resolved by the Legislature of Louisiana, two-thirds of the members
10 elected to each house concurring, that there shall be submitted to the electors of the state, for
11 their approval or rejection in the manner provided by law, a proposal to add Article VIII,
12 Section 7.2 of the Constitution of Louisiana, to read as follows:
13 ยง7.2.  Postsecondary Education Management Boards; Tuition and Fee
14	Authority; Admissions Authority
15	Section 7.2.  A. Notwithstanding the provisions of Article VII, Section
16 (2.1)(A), or any other provision of this constitution or law to the contrary, each
17 postsecondary education management board created by this Article shall have

1 the authority to establish the tuition and mandatory fee amounts charged by the
2 institutions under its supervision and management.
3	B. Notwithstanding any provision of this constitution or law to the
4 contrary, each postsecondary education management board created by this
5 Article shall have the authority to establish admissions standards and
6 requirements for each institution under its supervision and management.
7 Section 2.  Be it further resolved that this proposed amendment shall be submitted
8 to the electors of the state of Louisiana at the statewide election to be held on October 24,
9 2015, provided the Act which originated as Senate Bill No. 48 of this 2015 Regular Session
10 is enacted and becomes effective.
11 Section 3.  Be it further resolved that on the official ballot to be used at said election
12 there shall be printed a proposition, upon which the electors of the state shall be permitted
13 to vote YES or NO, to amend the Constitution of Louisiana which proposition shall read as
14 follows:
15	Do you support an amendment to authorize the postsecondary education
16	management boards to establish the tuition and mandatory fee amounts
17	charged by institutions under their supervision and management without
18	legislative approval and to establish admissions standards and requirements
19	for each institution under their supervision and management?

Present constitution (Art. VII, Sec. 2.1(A)) provides that any new fee or civil fine or increase
in an existing fee or civil fine imposed or assessed by the state or any board, department, or
agency of the state shall require the enactment of a law by a two-thirds vote of the elected
members of each house of the legislature.
Proposed constitutional amendment provides that, notwithstanding any constitutional
provision including Art. VII, Sec. 2.1(A) or any other law to the contrary, each
constitutionally created postsecondary education management board shall have the authority
to establish the tuition and fee amounts charged by institutions under its supervision and
management, without legislative approval.

Proposed constitutional amendment further provides that, notwithstanding any constitutional
provision or law to the contrary, each constitutionally created postsecondary education
management board shall have the authority to establish admission standards and
requirements for each institution under its supervision and management.
Specifies submission of the amendment to the voters at the statewide election to be held on
October 24, 2015, provided Senate Bill No. 48 of this 2015 Regular Session is enacted and
