Proposed law requires the executive director of Patient's Compensation Fund to submit a
report on an annual basis to the Senate and House committees on health and welfare no later
than January 31 that includes all of the following:
(1)All claims against all individual practitioners who have had five or more paid claims
for the previous year paid by the Patient's Compensation Fund.
(2)All paid claims for the previous year and the year immediately preceding that year,
as well as the total number of pending claims filed against that individual
practitioner.
(3)The name and address of the individual practitioner and a brief description of the acts
of omission or commission which gave rise to the paid claims.
Proposed law provides that for purposes of proposed law, "individual practitioner" means
any individual person licensed or certified by this state to provide health care or professional
services as a physician, dentist, registered or licensed practical nurse or certified nurse
assistant, certified registered nurse anesthetist, nurse midwife, licensed midwife, nurse
practitioner, clinical nurse specialist, pharmacist, optometrist, podiatrist, chiropractor,
physical therapist, occupational therapist, psychologist, social worker, licensed professional
counselor, licensed perfusionist, licensed respiratory therapist, licensed radiologic
technologist, or licensed clinical laboratory scientist.
Effective upon signature of the governor or lapse of time for gubernatorial action.

1. Changes the reporting requirement from licensing boards of Louisiana health
care providers to the executive director of the Patient's Compensation Fund.

The Committee Amendments Proposed by House Committee on Health and Welfare to
the engrossed bill:
1. Change the date provided in proposed law by which the Patient's Compensation
Fund's annual report is due to the legislature from Jan. 15 to Jan. 31.
2. Define "individual practitioner", for purposes of proposed law, as any individual
person licensed or certified by this state to provide health care or professional
services as a physician, dentist, registered or licensed practical nurse or certified
nurse assistant, certified registered nurse anesthetist, nurse midwife, licensed
midwife, nurse practitioner, clinical nurse specialist, pharmacist, optometrist,
podiatrist, chiropractor, physical therapist, occupational therapist, psychologist,
social worker, licensed professional counselor, licensed perfusionist, licensed
respiratory therapist, licensed radiologic technologist, or licensed clinical
laboratory scientist.

3. Revise proposed law requiring reports on certain claims against health care
providers to provide instead that the reports shall address claims against
individual practitioners.
4. Revise proposed law requiring, in part, that reports address acts which allegedly
gave rise to certain claims to provide instead that the reports shall address acts
which gave rise to the claims.
5. Add all paid claims for the previous year and the year immediately preceding
that year, as well as the total number of pending claims filed against the
individual practitioner, as items to be included in reports from the Patient's
Compensation Fund to the legislature required by proposed law.
