SENATE BILL NO. 165

Prefiled pursuant to Article III, Section 2(A)(4)(b)(i) of the Constitution of Louisiana.
TRANSPORTATION/DEV DEPT.  Provides relative to the office of multimodal commerce
within the Department of Transportation and Development. (see Act)
1	AN ACT
2 To amend and reenact R.S. 36:508.3(D), the introductory paragraph of R.S. 36:508.4(B),
3 and R.S. 36:508.4(B)(3) and (C), and Section 3 of Act No. 719 of the 2014 Regular
4 Session of the Legislature, and to enact R.S. 51:3136(A)(9), relative to the office of
5 multimodal commerce in the Department of Transportation and Development; to
6 provide for divisions in the office of multimodal commerce; to extend the time for
7 creation and approval of an operational plan for the office by the Multimodal
8 Commerce Advisory Commission; to add the commissioner of the office of
9 multimodal commerce as a member of the Louisiana Board of International
10 Commerce; to provide a time to appoint the commissioner of multimodal commerce;
11 and to provide for related matters.
12 Be it enacted by the Legislature of Louisiana:
13 Section 1. R.S. 36:508.3(D) is hereby amended and reenacted to read as follows: 
14 §508.3. Office of multimodal commerce; functions; commissioner; deputy
15	commissioner; powers and duties

17	D. The powers, duties, responsibilities, budgetary authority, employees,

1 equipment, facilities, and funding of the office of multimodal commerce shall be
2 allocated among the following divisions of such office:
3	(1) Commercial trucking.
4	(2) Ports and harbors waterways.
5	(3) Aviation.
6	(4) Rail Freight and passenger rail development.
7	(5) Maritime.
8	(6) Intercity public mass transit.

10 Section 2. The introductory paragraph of R.S. 36:508.4(B) and R.S. 36:508.4(B)(3)
11 and (C) are hereby amended and reenacted to read as follows:
12 §508.4. Multimodal Commerce Advisory Commission

14	B. The Multimodal Commerce Advisory Commission shall meet and develop
15 an operational plan for the 2015 2016 Regular Session of the Legislature for the
16 following:
17	(1)	*          *          *
18	(3) Proposed legislation for the 2015 2016 Regular Session of the Legislature
19 necessary to implement the operational plan on July 1, 2016.
20	C. The operational plan of the Multimodal Commerce Advisory Commission
21 shall be presented to the Senate and House committees on transportation, highways,
22 and public works for their review, amendment, and approval no later than February
23 1, 2015 2016.

25 Section 3. R.S. 51:3136(A)(9) is hereby enacted to read as follows:
26 §3136. Membership of board
A. The board shall consist of the following members:

3 Section 4.  Section 3 of Act No. 719 of the 2014 Regular Session of the Legislature
4 is hereby amended and reenacted to read as follows:
5	Section 3.  The provisions of Section 1 of this Act shall become effective on
6 July 1, 2016, except that the provisions of R.S. 36:508.3(C) shall become effective
7 January 12, 2016.
8 Section 5. The provisions of Section 1 of this Act shall become effective on July 1,
9 2016.
10 Section 6. The provisions of Section 2 of this Act shall become effective on July 1,
11 2015.
12 Section 7. The provisions of Sections 3 and 4 of this Act shall become effective on
13 January 12, 2016.

Present law (effective 7/1/16) provides for the six divisions within the office of multimodal
commerce:
(1)Commercial trucking.
(2)Ports and harbors.
(3)Aviation.
(4)Rail.
(5)Maritime.
(6)Intercity public mass transit.
Proposed law (effective 7/1/16) consolidates those divisions into four:
(1)Commercial trucking.
(2)Ports and waterways.
(3)Aviation.
(4)Freight and passenger rail development.

Present law requires the Multimodal Commerce Advisory Commission to meet and develop
an operational plan and proposed legislation for the 2015 Regular Session necessary to
implement the operational plan on July 1, 2016.  Present law further requires that the
operational plan be presented to the Senate and House committees on transportation,
highways, and public works for their review, amendment, and approval no later than
February 1, 2015.
Proposed law (effective 7/1/15) retains present law but extends the 2015 deadlines to 2016.
Present law provides for membership for the Louisiana Board of International Commerce.
Proposed law (effective 1/12/16) adds the commissioner of multimodal commerce as a
member.
Present law (effective 7/1/16) provides that the commissioner of multimodal commerce be
appointed by the governor.
Proposed law (effective 1/12/16) provides that the commissioner of multimodal commerce
be appointed by the governor.
(Amends R.S. 36:508.3(D), 508.4(B)(intro para) and (3) and (C), and Section 3 of Act 719
of 2014 R.S.; adds R.S. 51:3136(A)(9))
