(gov sig) 1 AN ACT 2 To amend and reenact R.S. 3:4201(3) and 4215(B) and to enact R.S. 3:4201(23), relative to 3 meat and poultry inspection; to provide relative to definitions; to provide for certain 4 exemptions to inspection requirements; and to provide for related matters. 5 Be it enacted by the Legislature of Louisiana: 6 Section 1. R.S. 3:4201(3) and 4215(B) are hereby amended and reenacted and R.S. 7 3:4201(23) is hereby enacted to read as follows: 8 §4201. Definitions 9 As used in this Chapter, except as otherwise specified, the following terms 10 shall have the meanings stated below: 11 * * * 12 (3) The term "meat broker" means any person, firm or corporation engaged 13 in the business of buying or selling carcasses, parts of carcasses, meat, or meat food 14 products of cattle, sheep, poultry, swine, goats, horses, mules or other equines on 15 commission, or otherwise negotiating purchases, or sales, or transactions of such 16 articles other than for his own account or as an employee of another person, firm or 17 corporation. Exemption; farmers, custom, and retailers, restaurants and similar retail 6 type establishments 7 * * * 8 B. The provisions of this Chapter requiring inspection of the slaughter of 9 animals and the preparation of carcasses, parts thereof, meat and meat food products 10 shall not apply when all of the following apply: 11 (1) The operations are of types traditionally and usually conducted at retail 12 stores, and restaurants, and similar retail type establishments. 13 (2) When said The operations are conducted at a retail store, restaurant, or 14 similar retail type establishment, owned by the same person that operates the 15 facility. and 16 (3) Are The products are for sale in normal retail quantities, or are part of 17 a normal retail service, and. 18 (4) Are The products are sold or provided to consumers at such 19 establishments. 20 (5) The products are sold and transported directly to the consumer by 21 the retail store, restaurant, or similar retail type establishment's employees or 22 a common carrier, provided there is no intervening transfer or storage. 23 * * * 24 Section 2. This Act shall become effective upon signature by the governor or, if not 25 signed by the governor, upon expiration of the time for bills to become law without signature 26 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If 27 vetoed by the governor and subsequently approved by the legislature, this Act shall become 28 effective on the day following such approval. DIGEST SB 178 Reengrossed 2015 Regular Session Amedee Present law defines the term "meat broker" as any person, firm or corporation engaged in the business of buying or selling carcasses, parts of carcasses, meat, or meat food products of cattle, sheep, poultry, swine, goats, horses, mules or other equines on commission, or otherwise negotiating purchases or sales of such articles other than for his own account or as an employee of another person, firm or corporation. Proposed law expands the definition of "meat broker" to include a person, firm or corporation engaged in the business of buying or selling carcasses, parts of carcasses, meat, or meat food products of cattle, sheep, poultry, swine, goats, horses, mules or other equines conducting transactions and otherwise retains present law. Proposed law defines "intervening transfer or storage" as no longer in possession of meat products. Present law (R.S. 3:4215) provides for exemptions to inspection requirements for the slaughter of animals and the preparation of carcasses. Proposed law clarifies that retail type establishments are exempt from inspections in certain circumstances. Proposed law additionally exempts meat and meat food products sold and transported directly to the consumer by a retail store, restaurant, or similar retail type establishment's employees or a common carrier without intervening transfer or storage from the inspection requirements. Effective upon signature of the governor or lapse of time for gubernatorial action.
