2015 Regular Session ENROLLED SENATE BILL NO. 246 BY SENATOR JOHN SMITH Prefiled pursuant to Article III, Section 2(A)(4)(b)(i) of the Constitution of Louisiana. 1 AN ACT 2 To authorize and provide for the transfer of certain state property; to authorize the transfer 3 of certain state property in Vernon Parish; to provide for the property description; to 4 provide for reservation of mineral rights; to provide terms and conditions; to provide 5 an effective date; and to provide for related matters. 6 Be it enacted by the Legislature of Louisiana: 7 Section 1. The commissioner of administration and the secretary of the 8 Department of Health and Hospitals, notwithstanding any other provision of law to the 9 contrary, are hereby authorized and empowered to convey, transfer, assign, lease or 10 deliver any interest, excluding mineral rights, the state may have to all or any portion 11 of the following described parcels of property, including any buildings, facilities, and 12 improvements thereon, to the governing authority of the city of Leesville: 13 PARCEL ONE: Blocks fifty-two (52) and Fifty-seven (57) of the West 14 side Addition to the Town of Leesville, Louisiana. 15 PARCEL TWO: Begin at the Southwest corner of Block Fifty-two (52) 16 of the West side Addition to the Town of Leesville, Louisiana, thence West 17 extending in a straight line with the south boundary line of said Block a distance 18 of 332 ½ feet to the West line of Section 23, Township 2 North, Range 9 West, 19 then North along the West line of said Section 23, a distance of 439 ½ feet; 20 thence East in a straight line with North boundary line of Block 57 of West side 21 Addition to the Town of Leesville, a distance of 321 ½ feet, thence South along 22 the West boundary line of Blocks 57 and 52 of the West Side Addition to the 23 Town of Leesville a distance of 452 feet to place of beginning. Containing 4.47 24 acres, more or less. 25 PARCEL THREE: Begin at a point 45.7 feet South of south-east corner 26 of NE 1/4 of NE 1/4, Section 22, Township 2 North, Range 9 West, and run 27 South 614 feet, West 317 feet, North 614 feet and East 317 feet to point of ACT No. 171 Page 1 of 2 Coding: Words which are struck through are deletions from existing law; words in boldface type and underscored are additions. SB NO. 246 ENROLLED 1 beginning, containing 4.468 acres, more or less. 2 PARCEL FOUR: Beginning at the Northwest corner of Block 51, West 3 Side Addition, to the Town of Leesville, Louisiana and from thence run West 4 200 feet for point of beginning, thence West 153 feet, thence south 100 feet, 5 thence East 153 feet, thence North 100 feet to point of beginning. Acquired by 6 deed dated September 27, 1922, recorded in COB 153, 419, of the Records of 7 Vernon Parish, Louisiana. 8 Section 2. The commissioner of administration and the secretary of the 9 Department of Health and Hospitals are hereby authorized to enter into such 10 agreements, covenants, conditions, and stipulations and to execute such documents as 11 necessary to properly effectuate any conveyance, transfer, assignment, lease or delivery 12 of title, excluding mineral rights, to the property, including any buildings, facilities, and 13 improvements thereon, described in Section 1, and as more specifically described in 14 any such agreements entered into and documents executed by and between the 15 commissioner of administration, the secretary of the Department of Health and 16 Hospitals, and the governing authority of city of Leesville, in exchange of consideration 17 proportionate to at least the appraised value of the property. 18 Section 3. This Act shall become effective upon signature by the governor or, if not 19 signed by the governor, upon expiration of the time for bills to become law without signature 20 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If 21 vetoed by the governor and subsequently approved by the legislature, this Act shall become 22 effective on the day following such approval.
