Places the office of telecommunications management within the office of technology services. (8/1/15) 1 AN ACT 2 To amend and reenact R.S. 39:140 and 245 and R.S. 43:1, and to repeal R.S. 49:205, relative 3 to the division of administration; to provide relative to the office of technology 4 services and the office of telecommunications management; to provide for 5 reorganization; to provide for the uniform consolidated mailroom; to provide for 6 supervision and control; to provide for purchasing printing and engraving; and to 7 provide for related matters. 8 Be it enacted by the Legislature of Louisiana: 9 Section 1. R.S. 39:140 and 245 are hereby amended and reenacted to read as 10 follows: 11 §140. Office of telecommunications management; creation and authority 12 There is hereby created, within the division of administration office of 13 technology services, the office of telecommunications management, headed by the 14 state director of the office of telecommunications management, under the supervision 15 and control of the commissioner of administration state chief information officer. 16 The director of the office of telecommunications management may employ and 17 supervise such assistants and other persons as may be necessary to discharge the Page 1 of 4 Coding: Words which are struck through are deletions from existing law; words in boldface type and underscored are additions. Rules and regulations shall be promulgated as may be 4 necessary to carry out the provisions of this Part. 5 * * * 6 §245. Uniform consolidated mailroom 7 A. The division of administration office of technology services shall 8 establish a uniform consolidated mailroom operation for all state agencies for 9 messenger, mail processing, and presort services. The commissioner state chief 10 information officer may establish a set of specifications, including but not limited 11 to types and sizes of envelopes and address print requirements to be used by all state 12 agencies. The commissioner state chief information officer is authorized to adopt 13 all necessary standards and guidelines to implement a uniform consolidated 14 mailroom operation, and is also authorized to promulgate all rules and regulations 15 necessary and proper toward that end, pursuant to the provisions of the 16 Administrative Procedure Act. 17 B. The office of technology services is authorized to bill the budget units 18 for such services at actual cost as nearly as can be determined, and settlements 19 therefor shall be made by warrants. The receipts for such services shall be 20 treated as reimbursements. 21 C. State colleges and universities, their management boards, and the Board 22 of Regents shall be excluded by the division of administration from the provisions 23 of Subsection A of this Section unless it can be verified that inclusion would result 24 in a savings to the respective college, university, or board. 25 * * * 26 Section 2. R.S. 43:1 is hereby amended and reenacted to read as follows: 27 §1. All administrative boards, commissions, departments, agencies, 2 institutions, and offices within the executive branch of the state government shall 3 purchase all requirements of printing and engraving through a central purchasing 4 agency the office of technology services in the division of administration. This 5 provision, however, shall not apply to the Louisiana State University System, the 6 Southern University System, the Board of Trustees of State Colleges and 7 Universities system, vocational-technical schools, special schools, and other 8 institutions under the supervision of the State Board of Elementary and Secondary 9 Education, the port authorities of the state, the legislature, the office of the State 10 Bond Commission in the Department of the Treasury, or the judiciary except that it 11 shall apply to the office of the attorney general. All procurement of such printing 12 and engraving for the executive departments of state government shall be done under 13 and in accordance with the provisions of the Louisiana Procurement Code. 14 B. In order to carry out the duties and functions imposed upon him by this 15 Chapter, in conjunction with the Louisiana Procurement Code, the chief procurement 16 state chief information officer shall have the power and authority: 17 (1) To consult, review, and make recommendations with regard to all printing 18 requirements in order that the best and most economical methods may be employed. 19 (2) To delegate the purchase of printing to any instrumentality covered by 20 this Chapter whenever in his written opinion the best interests of the state will be 21 served thereby. 22 (3) To use any and all powers and authority granted to him by law or 23 otherwise delegated to him by competent authority. 24 Section 3. Present law places the uniform consolidated mailroom for all state agencies under the control of DOA and the commissioner of administration. Proposed law moves uniform consolidated mailroom operations to OTS and control to the state chief information officer. Present law requires the executive branch purchase all requirements of printing and engraving from a central purchasing agency with the chief procurement officer having authority. Proposed law designates OTS as the vendor for all printing and engraving purchases made by the executive branch with the chief information officer having authority. Effective August 1, 2015.
