1	AN ACT
2 To amend and reenact R.S. 39:140, 141(B), and 245 and R.S. 43:1, and to repeal R.S.
3 49:205, relative to the division of administration; to provide relative to the office of
4 technology services and the office of telecommunications management; to provide
5 for reorganization; to provide for the uniform consolidated mailroom; to provide for
6 supervision and control; to provide for purchasing printing and engraving; and to
7 provide for related matters.
8 Be it enacted by the Legislature of Louisiana:
9 Section 1.  R.S. 39:140, 141(B), and 245 are hereby amended and reenacted to read
10 as follows:
11 §140.  Office of telecommunications management; creation and authority
12	There is hereby created, within the division of administration office of
13 technology services, the office of telecommunications management, headed by the
14 state director of the office of telecommunications management, under the supervision
15 and control of the commissioner of administration state chief information officer. 
16 The director of the office of telecommunications management may employ and
17 supervise such assistants and other persons as may be necessary to discharge the
18 duties of the office and may delegate authority to such designees or to any
19 governmental body as the director may deem appropriate within the limitations of
20 state law and regulations.  Rules and regulations shall be promulgated as may be

1 necessary to carry out the provisions of this Part.

3 §141.  Duties of the office of telecommunications management
4	*          *          *
5	B.  Agencies shall cooperate with the office of telecommunications
6 management's fulfillment of the office's duties as established by this Part.  However,
7 nothing provided in this Part shall be construed to preempt the authorities granted to
8 the higher education boards in Article VIII of the Constitution of Louisiana. Public
9 postsecondary institutions of education, their management boards, and the
10 Board of Regents shall be excluded from this Part unless the state chief
11 information officer can verify that inclusion per contracted service would result
12 in savings to the institution or board.

14 §245.  Uniform consolidated mailroom
15	A. The division of administration office of technology services shall
16 establish a uniform consolidated mailroom operation for all state agencies for
17 messenger, mail processing, and presort services.  The commissioner state chief
18 information officer may establish a set of specifications, including but not limited
19 to types and sizes of envelopes and address print requirements to be used by all state
20 agencies.  The commissioner state chief information officer is authorized to adopt
21 all necessary standards and guidelines to implement a uniform consolidated
22 mailroom operation, and is also authorized to promulgate all rules and regulations
23 necessary and proper toward that end, pursuant to the provisions of the
24 Administrative Procedure Act.
25	B. The office of technology services is authorized to bill the budget units
26 for such services at actual cost as nearly as can be determined, and settlements
27 therefor shall be made by warrants. The receipts for such services shall be
28 treated as reimbursements.
29	C. State colleges and universities, their management boards, and the Board
30 of Regents shall be excluded by the division of administration office of technology

1 services from the provisions of Subsection A of this Section unless it can be verified
2 that inclusion would result in a savings to the respective college, university, or board.

4 Section 2.  R.S. 43:1 is hereby amended and reenacted to read as follows:
5 §1.  Purchase of printing and engraving; central purchasing office of technology
6	services; Louisiana Procurement Code; power and authority of chief
7	procurement state chief information officer
8	A. All administrative boards, commissions, departments, agencies,
9 institutions, and offices within the executive branch of the state government shall
10 purchase all requirements of printing and engraving through a central purchasing
11 agency the office of technology services in the division of administration.  This
12 provision, however, shall not apply to the Louisiana State University System, the
13 Southern University System, the Board of Trustees of State Colleges and
14 Universities system, vocational-technical schools, postsecondary institutions of
15 education and their management boards, the Board of Regents, special schools,
16 and other institutions under the supervision of the State Board of Elementary and
17 Secondary Education, the port authorities of the state, the legislature, the office of
18 the State Bond Commission in the Department of the Treasury, or the judiciary
19 except that it shall apply to the office of the attorney general.  All procurement of
20 such printing and engraving for the executive departments of state government shall
21 be done under and in accordance with the provisions of the Louisiana Procurement
22 Code.
23	B. In order to carry out the duties and functions imposed upon him by this
24 Chapter, in conjunction with the Louisiana Procurement Code, the chief procurement
25 state chief information officer shall have the power and authority:
26	(1) To consult, review, and make recommendations with regard to all printing
27 requirements in order that the best and most economical methods may be employed.
28	(2) To delegate the purchase of printing to any instrumentality covered by
29 this Chapter whenever in his written opinion the best interests of the state will be
30 served thereby.

1	(3) To use any and all powers and authority granted to him by law or
2 otherwise delegated to him by competent authority.
3 Section 3.  R.S. 49:205 is hereby repealed.
