MOTOR VEHICLES.  Provides licensing exception to law enforcement officers operating
certain law enforcement vehicles. (gov sig)
1	AN ACT
2 To enact R.S. 32:402(C)(5), relative to motor vehicles; to provide a licensing exception for
3 law enforcement officers to operate certain law enforcement vehicles; and to provide
4 for related matters.
5 Be it enacted by the Legislature of Louisiana:
6 Section 1.  R.S. 32:402(C)(5) is hereby enacted to read as follows:
7 ยง402.  All drivers must secure license; exception; emergency vehicle exception;
8	military personnel exceptions; emergency command post vehicle
9	exception; law enforcement officer exception; violations

12	(5) Notwithstanding any provision of this Section or any other law to the
13 contrary, the only driver's license required of an operator of an emergency
14 command post vehicle or other law enforcement equipment which would
15 otherwise meet the definition of a commercial motor vehicle, and who is
16 employed as a law enforcement officer, shall be a Class "E" driver's license
17 when operating such vehicle or equipment in the course and scope of his

1 employment.  Such vehicle or equipment shall be equipped with audible and
2 visual signals as required by Federal Motor Carrier Safety Administration
3 rules.

5 Section 2. This Act shall become effective upon signature by the governor or, if not
6 signed by the governor, upon expiration of the time for bills to become law without signature
7 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
8 vetoed by the governor and subsequently approved by the legislature, this Act shall become
9 effective on the day following such approval.

Present law requires every person who operates a motor vehicle which is designated as being
in either Class "A", "B", "C", "D", or "E" by R.S. 32:408 to secure the appropriately
classified driver's license with all necessary endorsements before driving or operating any
such motor vehicle on any public street, road, or highway of this state.
Proposed law retains present law and provides a licensing exception from present law for an
operator of an emergency command post vehicle or other law enforcement equipment which
meets the definition of a commercial motor vehicle and who is employed as a law
enforcement officer when operating such vehicle or equipment in the course and scope of
his employment.  Requires such vehicle or equipment to be equipped with audible and visual
signals required by Federal Motor Carrier Safety Administration rules.
Proposed law provides that such operator is only required to have a Class "E" driver's
license.
Effective upon signature of the governor or lapse of time for gubernatorial action.
