2015 Regular Session ENROLLED SENATE BILL NO. 67 BY SENATOR WHITE Prefiled pursuant to Article III, Section 2(A)(4)(b)(i) of the Constitution of Louisiana. 1 AN ACT 2 To enact R.S. 32:402(C)(5) and (F), relative to motor vehicles; to provide a licensing 3 exception for law enforcement officers to operate certain law enforcement vehicles; 4 to provide relative to licensing requirements of certain operators of vehicles in 5 limited circumstances; and to provide for related matters. 6 Be it enacted by the Legislature of Louisiana: 7 Section 1. R.S. 32:402(C)(5) and (F) are hereby enacted to read as follows: 8 ยง402. All drivers must secure license; exception; emergency vehicle exception; 9 military personnel exceptions; emergency command post vehicle 10 exception; law enforcement officer exception; violations 11 * * * 12 C. * * * 13 (5) Notwithstanding any provision of this Section or any other law to the 14 contrary, the only driver's license required of an operator of an emergency 15 command post vehicle or other law enforcement equipment which would 16 otherwise meet the definition of a commercial motor vehicle, and who is 17 employed as a law enforcement officer, shall be a Class "E" driver's license 18 when operating such vehicle or equipment in the course and scope of his 19 employment. SB NO. 67 ENROLLED 1 F.(1) The exceptions provided for in Subsection C of this Section shall 2 only apply to drivers licensed by the state of Louisiana and drivers licensed by 3 a state with which Louisiana has a reciprocity agreement. 4 (2) The exceptions in Subparagraphs (C)(1), (2), (4), and (5) of this 5 Section shall only apply to the operation of commercial motor vehicles for which 6 the particular exception applies when those commercial motor vehicles are 7 equipped with audible and visual signals and the operation of the commercial 8 motor vehicle is necessary for the preservation of life or property or in the 9 execution of emergency governmental functions. 10 Section 2. This Act shall become effective upon signature by the governor or, if not 11 signed by the governor, upon expiration of the time for bills to become law without signature 12 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If 13 vetoed by the governor and subsequently approved by the legislature, this Act shall become 14 effective on the day following such approval.
