PARISHES.  Provides for information of any negative impact on surrounding parishes to be
included in applications for funding of any flood-control projects. (8/1/15)
1	AN ACT
2 To enact R.S. 38:90.4(A)(1)(j), relative to the Statewide Flood-Control Program; to provide
3 for information to be included in applications for funding of any flood-control
4 projects; and to provide for related matters.
5 Be it enacted by the Legislature of Louisiana:
6 Section 1.  R.S. 38:90.4(A)(1)(j) is hereby enacted to read as follows: 
7 ยง90.4. Methodology for flood-control project evaluation
8	A.(1) Applications for funding of any flood-control projects under the
9 Statewide Flood Control Program may be submitted by any duly authorized
10 municipal, parish, or other governing authority. Applications shall be made to the
11 office of engineering by October first of each year, for consideration of funding in
12 the following fiscal year. Applications submitted in accordance with the provisions
13 of this Chapter shall not be subject to the provisions of R.S. 39:101. Sponsoring
14 authorities with a population of fifty thousand persons or more shall be responsible
15 for the preparation of applications for their respective projects. For sponsoring
16 authorities with a population of less than fifty thousand persons, the office shall
17 prepare the applications for the projects, or the sponsoring authority may prepare its

1 application in the event the office cannot accomplish required engineering services
2 in a timely manner. Information to be provided in the application shall include but
3 not be limited to the following:

5	(j) Any negative and positive impact on adjacent parishes both upstream
6 and downstream from the project.

Present law provides for information to be provided in the application for funding of any
flood-control projects under the Statewide Flood Control Program.
Proposed law retains present law and adds a requirement that the application include any
negative and positive impact of the project on surrounding parishes.
Effective August 1, 2015.
