SLS 15RS-517 ORIGINAL 2015 Regular Session SENATE CONCURRENT RESOL UTION NO. 100 BY SENATOR DORSEY-COLOMB CRIMINAL JUSTICE. Requests the Louisiana State Law Institute to study the impact on reducing the delays in carrying out a capital punishment sentence. 1 A CONCURRENT RESOL UTION 2 To urge and request the Louisiana State Law Institute to study and make recommendations 3 that would accelerate the state capital punishment appeal process. 4 WHEREAS, a study is needed to determine the feasibility of combining the direct 5 and post-conviction appeals of a defendant who has been sentenced to capital punishment; 6 and 7 WHEREAS, Louisiana has more than eighty inmates serving sentences for capital 8 punishment; and 9 WHEREAS, many of those inmates have been awaiting decades for the conclusion 10 of clemency review; and 11 WHEREAS, the legislature recognizes the importance of collecting and verifying 12 objective statistical data on the cost of capital punishment in Louisiana; and 13 WHEREAS, questions are frequently raised regarding the costs of the administration 14 of a system of capital punishment; and 15 WHEREAS, there is a need to discuss the timely processing of a capital punishment 16 case in a systematic and effective manner through the conclusion of clemency review. 17 THEREFORE, BE IT RESOLVED that the Legislature of Louisiana does hereby 18 request the Law Institute to study and make recommendations that would accelerate the state Page 1 of 2 SCR NO. 100 SLS 15RS-517 ORIGINAL 1 capital punishment appeal process. 2 BE IT FURTHER RESOLVED that the Louisiana State Law Institute shall submit 3 a written report of its findings, together with any proposed legislation, to the Legislature of 4 Louisiana no later than February 1, 2016. 5 BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the 6 Director of the Louisiana State Law Institute.
