SLS 15RS-3836 ORIGINAL 2015 Regular Session SENATE RESOLUTION NO. 218 BY SENATOR BROWN WORKERS' COMPENSATION. Requests the Louisiana Workers' Compensation Corporation to review and adjust the code and classification of nonskilled home health workers. 1 A RESOLUTION 2 To urge and request the Louisiana Workers' Compensation Corporation review and adjust 3 the code and classification of nonskilled home health workers whose duties are 4 currently being classified the same as the more hazardous duties of skilled home 5 health nurses and nurses aides, whose employment duties are skilled in nature. 6 WHEREAS, in 1991 the legislature established the Louisiana Workers' 7 Compensation Corporation when the legislature declared that "an adequate market for 8 workers' compensation insurance is necessary to the economic welfare of the state and that 9 without such insurance, the orderly growth and development of the state would be severely 10 impeded; that, furthermore, adequate insurance for workers' compensation is necessary to 11 enable employers to satisfy their legal obligation" to provide workers' compensation 12 insurance. (R.S. 23:1391(A)); and 13 WHEREAS, in 1991 the legislature further declared that it "is the purpose of the 14 corporation to provide a residual market for those employers that have in good faith, but 15 without success, sought workers' compensation insurance in the voluntary market of 16 insurance; to provide a competitive market for preferred risk policies as defined herein; and 17 to insure that rates charged are adequate to provide solvency and self-funding of the 18 corporation." (R.S. 23:1391(A)); and Page 1 of 2 SR NO. 218 SLS 15RS-3836 ORIGINAL 1 WHEREAS, elderly and special needs persons require home health services that are 2 nonskilled in nature such as light house keeping and cooking; and 3 WHEREAS, workers' compensation companies, including Louisiana's own Louisiana 4 Workers' Compensation Corporation, codes and classifies nonskilled home health workers 5 who provide housekeeping and cooking services, the same code and classification as skilled 6 home health workers such as nurses and nurses aides, even though skilled home health 7 workers' duties are more hazardous in nature. 8 THEREFORE, BE IT RESOLVED that the Senate of the Legislature of Louisiana 9 does hereby urge and request that the Louisiana Workers' Compensation Corporation review 10 and adjust the code and classification of nonskilled home health workers whose duties are 11 currently being classified the same as the more hazardous duties of skilled home health 12 nurses and nurses aides. 13 BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the 14 Louisiana Workers' Compensation Corporation.
