SENATE RESOLUTION NO. 225
BY SENATOR CROWE 
SENATE.  Establishes the Louisiana Countermand Resolution Study Task Force.
1	A RESOLUTION
2 To create and provide for the Louisiana Countermand Resolution Study Task Force to study
3 the practicality and the possibility of enacting a Countermand Amendment to the
4 Constitution of the United States of America.
5 WHEREAS, a Countermand Amendment to the Constitution of the United States of
6 America would allow the states to rescind any unfunded and unconstitutional mandates on
7 the states enacted by congressional statute, judicial decision, executive order, treaty,
8 government agency's regulatory ruling, or any other government or nongovernment mandate
9 (including excessive spending and credit) imposed on the states when, in the opinion of sixty
10 percent of state legislatures, the law or ruling adversely affects their states' interest; and
11 WHEREAS, the authority of Congress, under Article V of the Constitution of the
12 United States of America, requires it to convene a convention as called for if the state
13 legislatures desire an amendment to the Constitution of the United States of America; and
14 WHEREAS, the Senate of the Legislature of Louisiana believes that it would be
15 helpful to the people of Louisiana to study whether or not electing delegates to a
16 Countermand Convention to the Constitution of the United States of America would be in
17 the best interest of the state of Louisiana.
18 THEREFORE, BE IT RESOLVED that the Senate of the Legislature of Louisiana

1 hereby creates the Louisiana Countermand Resolution Study Task Force to study the
2 practicality and the possibility of enacting a Countermand Amendment to the Constitution
3 of the United States of America and to recommend any action or legislation that the task
4 force deems necessary and appropriate to the legislature.
5 BE IT FURTHER RESOLVED that the task force created herein shall consist of the
6 following eight members:
7 (1)The president of the Senate or his designee.
8 (2)The speaker of the House of Representatives or his designee.
9 (3)Three members of the Senate appointed by the president, one of whom shall
10	be a member of the minority party, and one of whom shall be designated by
11	the president as co-chairperson.
12 (4)Three members of the House of Representatives appointed by the speaker,
13	one of whom shall be a member of the minority party, and one of whom shall
14	be designated by the speaker as co-chairperson.
15 BE IT FURTHER RESOLVED that in conducting such study, the task force may
16 review any and all existing agent federal statutes, mandates or executive orders and
17 recommend nullification of any bill that is unconstitutional to the legislature.
18 BE IT FURTHER RESOLVED that the members of the task force shall serve
19 without compensation, except per diem or expenses reimbursement to which they may be
20 individually entitled as members of the constituent organizations.
21 BE IT FURTHER RESOLVED that a majority of the total membership shall
22 constitute a quorum of the task force and any official action by the task force shall require
23 an affirmative vote of a majority of the quorum present and voting.
24 BE IT FURTHER RESOLVED that the task force may conduct such meetings at
25 such times as it may deem necessary or convenient to enable it to exercise fully and
26 effectively its powers, perform its duties, and accomplish the objectives and purposes of this
27 Resolution.
28 BE IT FURTHER RESOLVED that the staff assigned to the Senate Committee on
29 Labor and Industrial Relations shall serve as staff for the task force.
30 BE IT FURTHER RESOLVED that the task force shall make a written report of its

1 findings and recommendations, with suggestions for proposed legislation, if any, to the
2 legislature no later than sixty days prior to the convening of the 2016 Regular Session.

Provides that the task force consist of the following eight members:
(1)The president of the Senate or his designee.
(2)The speaker of the House of Representatives or his designee.
(3)Three members of the Senate appointed by the president, one of whom shall be a
member of the minority party, and one of whom shall be designated by the president
as co-chairperson.
(4)Three members of the House of Representatives appointed by the speaker, one of
whom shall be a member of the minority party, and one of whom shall be designated
by the speaker as co-chairperson.
