APPROPRIATIONS/SUPPLEML:  Makes supplemental appropriations for Fiscal Year
2016-2017 (Item #1)
1	AN ACT
2To appropriate funds and to make certain reductions from certain sources to be allocated to
3 designated agencies and purposes in specific amounts and for the making of
4 supplemental appropriations and reductions for said agencies and purposes for Fiscal
5 Year 2016-2017; to provide for an effective date; and to provide for related matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1.  The following sums are hereby appropriated or the appropriations are
8hereby reduced from the sources specified and in the amounts specified for the purpose of
9making supplemental appropriations and reductions for Fiscal Year 2016-2017.  Reductions
10are denoted in parentheses.  Appropriations contained in this Section are designated as
11supplementary budget recommendations from the sources of revenue specified and shall
12become effective in the event the official forecast for Fiscal Year 2016-2017 is revised at the
13meeting of the Revenue Estimating Conference to incorporate additional revenue as a result
14of enactment of instruments of the 2016 Second Extraordinary Session of the Legislature.

18Provided, however, that the commissioner of administration is authorized and directed to
19adjust the expenditures for this agency as contained in the Act that orginated as HB 1 of the
20of the 2016 Regular Session of the Legislature by reducing the expenditures out of the
21Litigation Program by ($1,000,000) and increasing the expenditures out of the
22Administrative Program by $1,000,000.

1The Attorney General is permitted to use the $7,000,000 received from the Coastal
2Protection and Restoration Authority and/or the DWH Court Order regarding Attorney Fees
3and Costs to fund appropriations to the Office of the Attorney General out of the State
4General Fund by Fees and Self-Generated Revenues and the State General Fund by Statutory
5Dedications out of the Department of Justice Legal Support Fund.

8Provided, however, that of the funds appropriated from State General Fund (Direct) to this
9agency as contained in the Act that originated as HB 1 of the 2016 Regular Session of the
10Legislature an additional $50,511,446 shall be allocated for payments to the public private
11partnership hospitals.  Provided, further, that of the funds appropriated from Federal Funds
12to this agency as contained in the Act that originated as HB 1 of the 2016 Regular Session
13of the Legislature an additional $83,346,242 shall be allocated for payments to the public
14private partnership hospitals.
15The commissioner of administration is hereby authorized and directed to adjust the means
16of financing in this agency as contained in the Act that originated as HB 1of the 2016
17Regular Session of the Legislature by reducing the appropriation out of the State General
18Fund (Direct) by ($111,988,554) and the appropriation out of Federal Funds by ($
19184,748,473).

5Provided, however, that of the funds appropriated from State General Fund (Direct) to the
6Louisiana Judiciary in this Act and in the Act that originated as House Bill 616 of the 2016
7Regular Session of the Legislature, $3,045,170 shall be allocated for Court Appointed
8Special Advocates (CASA).  
9Provided, however, that of the funds appropriated from State General Fund (Direct) to the
10Louisiana Judiciary in this Act and in the Act that originated as House Bill 616 of the 2016
11Regular Session of the Legislature, $12,609,755 shall be allocated for Drug Courts.  
12 Section 2.  (1)  The sum of Two Hundred Forty Thousand Six Hundred Thirty-Eight
13and No/100 ($240,638.00) Dollars, plus interest from April 25, 2011 until paid, plus attorney
14fees in the amount of One Hundred Sixty-Five Thousand and No/100 ($165,000.00), plus
15costs in the amount of Thirty-Seven Thousand Seven Hundred Fourteen and 51/100
16($37,714.51), plus interest from September 2, 2014 until paid, is hereby appropriated out of
17the General Fund of the state of Louisiana for Fiscal Year 2016-2017 to be used to pay the
18judgments in the suit entitled "Board of Supervisors of Louisiana State University and
19Agricultural and Mechanical College v. Michael P. Villavaso", bearing Number 11-3852,
20Division "D", Section "16", on the docket of the Civil District Court, parish of Orleans, state
21of Louisiana.
22 (2)  Interest awarded in this judgment shall be calculated pursuant to R.S. 19:155 at
235% per annum.
24 All judgments provided for in this Section shall be paid as to principal, interest, court
25costs, and expert witness fees as provided in said judgments, it being the intent herein that
26when the provisions of any judgment conflict with the provisions of this Act, the provisions
27of the judgment shall be controlling.  Any other provision of this Act, not in conflict with
28the provisions of such judgment, shall control.  Payment shall be made as to any such
29judgment only after presentation to the state treasurer of documentation required by the state
30treasurer. 
31 Section 3.  This Act shall become effective on July 1, 2016.
