HOUSE BILL NO. 1043

PHARMACISTS:  Provides relative to the licensure of therapeutic marijuana dispensing
pharmacies
1	AN ACT
2To amend and reenact R.S. 40:1046(I), relative to the licensure of therapeutic marijuana
3 dispensing pharmacies; to remove the limit on the number of therapeutic marijuana
4 dispensing pharmacy licenses that may be issued; and to provide for related matters.
5Be it enacted by the Legislature of Louisiana:
6 Section 1.  R.S. 40:1046(I) is hereby amended and reenacted to read as follows: 
7 ยง1046.  Prescription of marijuana for therapeutic use; rules and regulations; 
8	Louisiana Board of Pharmacy and the adoption of rules and regulations
9	relating to the dispensing pharmacies; of prescribed marijuana for therapeutic
10	use; the Department of Agriculture and Forestry and the licensure of a
11	production facility

13	I.  The Louisiana Board of Pharmacy shall develop an annual,
14 nontransferable specialty license for a pharmacy to dispense prescribed marijuana
15 for therapeutic use. and shall limit the number of such licenses granted in the state
16 to no more than ten licensees.  The Louisiana Board of Pharmacy shall develop rules
17 and regulations regarding the geographical locations of dispensing pharmacies in
18 Louisiana.

Abstract:  Removes the limit on the number of therapeutic marijuana dispensing pharmacy
licenses that may be issued.
Present law requires the La. Board of Pharmacy to develop an annual, nontransferable
specialty license for a pharmacy to dispense prescribed marijuana for therapeutic use.  
Proposed law retains present law.
Present law prohibits the board from granting more than 10 therapeutic marijuana dispensing
pharmacy licenses.
Proposed law repeals the limit on the number of therapeutic marijuana dispensing pharmacy
licenses that may be issued.
