MEDICAID: Authorizes the assessment of a provider fee on Medicaid managed care
organizations
1 AN ACT
2To enact R.S. 46:2625.1, relative to Medicaid managed care organizations; to authorize a
3 provider fee on Medicaid managed care organizations; to establish a maximum fee
4 amount; and to provide for related matters.
5Be it enacted by the Legislature of Louisiana:
6 Section 1. R.S. 46:2625.1 is hereby enacted to read as follows:
7 ยง2625.1. Fees on Medicaid managed care organizations
8 A. The Department of Health and Hospitals may adopt and impose fees for
9 healthcare services provided by Medicaid managed care organizations pursuant to
10 42 CFR 433.50 et seq.
11 B. The amount of the fee shall not exceed the maximum amount permitted
12 by the federal Medicaid regulations including any adjustments of that maximum as
13 provided therein.
14 C. The department shall take all such actions necessary to implement this
15 Section including but not limited to the promulgation of rules and regulations in
16 accordance with the Administrative Procedure Act.

Abstract: Authorizes the Dept. of Health and Hospitals (DHH) to assess and collect a
provider fee on Medicaid managed care organizations.
Present law authorizes provider fees to be paid by certain healthcare providers.
Proposed law retains present law and establishes a provider fee for Medicaid managed care
organizations which shall not exceed the maximum amount permitted by the federal
Medicaid regulations including any adjustments of that maximum.
Proposed law requires DHH to take all such actions necessary to implement proposed law.
