State Board of Nursing 1 AN ACT 2To amend and reenact R.S. 37:914(B)(1), 916, 917, and 927(A), relative to the Louisiana 3 State Board of Nursing; to provide for composition of the board and qualifications 4 of board members; to provide relative to the fee schedule of the board; and to 5 provide for related matters. 6Be it enacted by the Legislature of Louisiana: 7 Section 1. R.S. 37:914(B)(1), 916, 917, and 927(A) are hereby amended and 8reenacted to read as follows: 9 §914. Louisiana State Board of Nursing; appointment of members; term of office; 10 vacancy; officers; compensation 11 * * * 12 B.(1) The board shall be composed of eight registered nurses appointed by 13 the governor from a list of names submitted by the Louisiana State Nurses 14 Association, one certified registered nurse anesthetist appointed by the governor 15 from a list of names submitted by the Louisiana Association of Nurse Anesthetists, 16 Ltd., and two physicians, appointed by the governor from a list of names submitted 17 by the Louisiana State Medical Society, who shall serve as ex officio members of the 18 board and shall serve only as advisors to the board and shall not vote and two 19 representatives of the consumers of Louisiana from the state at-large appointed by Page 1 of 4 CODING: Words in struck through type are deletions from existing law; words underscored are additions. HLS 16RS-3216 ORIGINAL HB NO. 1161 1 the governor, neither of whom shall be a nurse. Each board member shall possess 2 all of the applicable qualifications provided in R.S. 37:916. 3 * * * 4 §916. Qualifications of board members 5 A.(1) Each registered nurse and advanced practice registered nurse member 6 of the board shall possess all of the following qualifications: 7 (1) Be (a) Is a citizen of the United States and has been a resident of 8 Louisiana for at least one year immediately prior to appointment. 9 (2) Hold (b) Holds a current, unencumbered, unrestricted, Louisiana license 10 to practice as a registered nurse. 11 (3) Have had (c) Has at least three years of experience in respective a field 12 of nursing practice. 13 (4) Be (d) Is actively engaged in the practice of nursing as a registered nurse 14 at the time of appointment. 15 B. (2) In addition to the qualifications provided in Paragraph (1) of this 16 Subsection A, at least two registered nurse members of the board shall have a 17 minimum of a bachelor of science degree in nursing. 18 B. Each consumer member of the board shall possess all of the following 19 qualifications: 20 (1) Is a citizen of the United States and has been a resident of Louisiana for 21 at least one year immediately prior to appointment. 22 (2) Has attained the age of majority. 23 (3) Has never engaged in any activity directly related to the practice of 24 professional nursing. 25 (4) Has never been convicted of a felony. 26 §917. Composition of board 27 The board shall be composed of two members who are nursing service 28 administrators,; three members who are nurse educators,; three members who are in 29 other areas of nursing practice, and one of whom is an advanced practice registered Page 2 of 4 CODING: Words in struck through type are deletions from existing law; words underscored are additions. In addition, there shall be two 2 physicians as ex officio members of the board to serve as non-voting advisors to the 3 board consumer members of the board as provided in R.S. 37:914(B). 4 * * * 5 §927. Fees 6 A. The board shall establish a reasonable fee schedule for the issuance or 7 renewal of any license or permit, registration services, examination fees, consultation 8 or presentation fees, or any other administrative function provided for in this Part. 9 Such fee schedule may be modified from time to time as deemed necessary by the 10 board. Such fee schedule shall include reasonable fees and administrative charges, 11 not to exceed one hundred dollars per calendar year, for the issuance or renewal of 12 any license or permit for practicing as a registered nurse or an advanced practice 13 registered nurse, and shall include a late fee for issuance or renewal of any such 14 license or permit not to exceed one hundred dollars per calendar year. The fee 15 schedule set by the board may also include additional fees and costs which may be 16 assessed in disciplinary proceedings as authorized by R.S. 37:925(D). 17 * * * DIGEST The digest printed below was prepared by House Legislative Services. Present law provides that the La. State Board of Nursing, referred to hereafter as "the board", shall be composed of eight registered nurses appointed by the governor from a list of names submitted by the La. State Nurses Association, one certified registered nurse anesthetist appointed by the governor from a list of names submitted by the La. Association of Nurse Anesthetists, Ltd., and two physicians appointed by the governor from a list of names submitted by the La. State Medical Society who shall serve as ex officio members of the board and shall serve only as advisors and shall not vote. Proposed law revises the composition of the board provided in present law to remove the two nonvoting physician members and add in lieu thereof two members who are representatives of the consumers of the state at-large appointed by the governor, neither of whom shall be a nurse, and both of whom shall be voting members. HLS 16RS-3216 ORIGINAL HB NO. 1161 Proposed law requires that each consumer member of the board possess all of the following qualifications: (1)Is a citizen of the United States and has been a resident of La. for at least one year immediately prior to appointment. (2)Has attained the age of majority. (3)Has never engaged in any activity directly related to the practice of professional nursing. (4)Has never been convicted of a felony. Present law provides that the board shall be composed, in part, of three members who are in areas of nursing practice other than nursing service administration or nursing education and one advanced practice registered nurse. Proposed law revises present law to provide that the board shall be composed, in part, of three members who are in areas of nursing practice other than nursing service administration or nursing education, one of whom shall be an advanced practice registered nurse, and one certified registered nurse anesthetist. Present law requires the board to establish reasonable fees for issuance and renewal of licenses and permits, and provides that such fees shall not exceed $100. Proposed law retains present law and stipulates that such fees shall not exceed $100 per calendar year.
