HOUSE BILL NO. 1161    (Substitute for House Bill No. 979 by Representative Dustin

BY REPRESENTATIVES DUSTIN MILLER, BAGLEY, COX, HORTON, JACKSON,
MAGEE, AND WILLMOTT
1	AN ACT
2 To amend and reenact R.S. 37:914(B)(1), 916, 917, and 927(A) and to enact R.S.
3 37:920(B)(3), relative to the Louisiana State Board of Nursing; to provide for
4 composition of the board and qualifications of board members; to provide for
5 licensure by endorsement of applicants to the board; to provide relative to the fee
6 schedule of the board; and to provide for related matters.
7 Be it enacted by the Legislature of Louisiana:
8 Section 1.  R.S. 37:914(B)(1), 916, 917, and 927(A) are hereby amended and
9 reenacted and R.S. 37:920(B)(3) is hereby enacted to read as follows:
10 §914.  Louisiana State Board of Nursing; appointment of members; term of office;

1	B.(1)  The board shall be composed of eight registered nurses appointed by
2 the governor from a list of names submitted by the Louisiana State Nurses
3 Association, one certified registered nurse anesthetist appointed by the governor
4 from a list of names submitted by the Louisiana Association of Nurse Anesthetists,
5 Ltd., and two physicians, appointed by the governor from a list of names submitted
6 by the Louisiana State Medical Society, who shall serve as ex officio members of the
7 board and shall serve only as advisors to the board and shall not vote and two
8 representatives of the consumers of Louisiana from the state at-large appointed by
9 the governor, neither of whom shall be a nurse.  Each board member shall possess
10 all of the applicable qualifications provided in R.S. 37:916.

12 §916.  Qualifications of board members
13	A.(1)  Each registered nurse and advanced practice registered nurse member
14 of the board shall possess all of the following qualifications:
15	(1)  Be (a)  Is a citizen of the United States and has been a resident of
16 Louisiana for at least one year immediately prior to appointment.
17	(2)  Hold (b)  Holds a current, unencumbered, unrestricted, Louisiana license
18 to practice as a registered nurse.
19	(3)  Have had (c)  Has at least three years of experience in respective a field
20 of nursing practice.
21	(4)  Be (d)  Is actively engaged in the practice of nursing as a registered nurse
22 at the time of appointment.
23	B. (2)  In addition to the qualifications provided in Paragraph (1) of this
24 Subsection A, at least two registered nurse members of the board shall have a
25 minimum of a bachelor of science degree in nursing.
26	B.  Each consumer member of the board shall possess all of the following
27 qualifications:
28	(1)  Is a citizen of the United States and has been a resident of Louisiana for
29 at least one year immediately prior to appointment.

1	(2)  Has attained the age of majority.
2	(3)  Has never engaged in any activity directly related to the practice of
3 professional nursing.
4	(4)  Has never been convicted of a felony.
5 §917.  Composition of board
6	The board shall be composed of two members who are nursing service
7 administrators,; three members who are nurse educators, one of whom is a
8 representative of an associate degree program in nursing, if such a representative
9 applies to be and is submitted as a candidate for board membership in accordance
10 with the provisions of R.S. 37:914(B); three members who are in other areas of
11 nursing practice, and one of whom is an advanced practice registered nurse; and one
12 certified registered nurse anesthetist.  In addition, there shall be two physicians as ex
13 officio members of the board to serve as non-voting advisors to the board consumer
14 members of the board as provided in R.S. 37:914(B).

20	(3)  The board may conduct licensure by endorsement only in accordance
21 with the provisions of this Subsection.

23 §927.  Fees
24	A.  The board shall establish a reasonable fee schedule for the issuance or
25 renewal of any license or permit, registration services, examination fees, consultation
26 or presentation fees, or any other administrative function provided for in this Part. 
27 Such fee schedule may be modified from time to time as deemed necessary by the
28 board.  Such fee schedule shall include reasonable fees and administrative charges,
29 not to exceed one hundred dollars per calendar year, for the issuance or renewal of
30 any license or permit for practicing as a registered nurse or an advanced practice

1 registered nurse, and shall include a late fee for issuance or renewal of any such
2 license or permit not to exceed one hundred dollars per calendar year.  The fee
3 schedule set by the board may also include additional fees and costs which may be
4 assessed in disciplinary proceedings as authorized by R.S. 37:925(D).
