PROPERTY/EXPROPRIATION: Provides relative to the expropriation of property for
certain sewer projects in the city of Pineville
1 AN ACT
2To amend and reenact R.S. 19:138(A) and (D), relative to expropriation by the city of
3 Pineville; to authorize expropriation by a declaration of taking for certain sewer
4 relocation projects; and to provide for related matters.
5 Notice of intention to introduce this Act has been published
6 as provided by Article III, Section 13 of the Constitution of
7 Louisiana.
8Be it enacted by the Legislature of Louisiana:
9 Section 1. R.S. 19:138(A) and (D) are hereby amended and reenacted to read as
10follows:
11 ยง138. City of Pineville; Susek Drive Project Main Street to Sanders Street sewer
12 relocation project; acquisition of property prior to judgment; definitions
13 A. When the governing authority of the city of Pineville cannot amicably
14 acquire property needed for its Susek Drive Main Street to Sanders Street sewer
15 relocation project, it may acquire the same by expropriation and may acquire the
16 property prior to judgment in the trial court fixing the amount of compensation due
17 to the owner of the property.

19 D. As used in this Part, the term "property" means any portion of immovable
20 property, including servitudes, rights of way, and other rights in or to immovable

1 property; the term "governing authority" means the governing authority of the city
2 of Pineville; and the term "project" means the Susek Drive Project Main Street to
3 Sanders Street sewer relocation project.

Abstract: Authorizes expropriation by a declaration of taking by the city of Pineville for
the Main Street to Sanders Street sewer relocation project.
Present law provides that the city of Pineville may acquire property for the Susek Drive
Project by expropriation by a declaration of taking when the city cannot amicably acquire
the property needed for the project.
Present law provides notice and procedures for expropriation by a declaration of taking.
Proposed law retains the present law notice and procedural requirements but changes the
project for which expropriation by a declaration of taking is authorized from the Susek Drive
Project to the Main Street to Sanders Street sewer relocation project.
