HOUSE BILL NO. 140

1	AN ACT
2 To amend and reenact R.S. 14:95(H)(1) and (K), relative to the carrying of concealed
3 weapons; to provide relative to the crime of illegal carrying of weapons; to provide
4 for exceptions; and to provide for related matters.
5 Be it enacted by the Legislature of Louisiana:
6 Section 1.  R.S. 14:95(H)(1) and (K) are hereby amended and reenacted to read as
7 follows: 
8 ยง95.  Illegal carrying of weapons

10	H.(1)  Except as provided in Paragraph (A)(5) of this Section and in
11 Paragraph (2) of this Subsection, the provisions of this Section shall not prohibit
12 active justices or judges of the supreme court, courts of appeal, district courts, parish
13 courts, juvenile courts, family courts, city courts, federal courts domiciled in the state
14 of Louisiana, and traffic courts, members of either house of the legislature, officers
15 of either house of the legislature, the legislative auditor, designated investigative
16 auditors, constables, coroners, designated coroner investigators, district attorneys and
17 designated assistant district attorneys, United States attorneys and assistant United
18 States attorneys and investigators, the attorney general, designated assistant attorneys
19 general, and justices of the peace from possessing and concealing a handgun on their
20 person when the justice or judge, legislator or officer of the legislature, legislative
21 auditor, designated investigative auditor, constable, coroner, designated coroner
22 investigators, district attorneys and designated assistant district attorneys, United
23 States attorneys and assistant United States attorneys and investigators, or justices
24 of the peace such persons are qualified annually in the use of firearms by the Peace

4	K.(1)  The provisions of this Section shall not prohibit a retired justice or
5 judge of the supreme court, courts of appeal, district courts, parish courts, juvenile
6 courts, family courts, city courts, retired attorney general, retired assistant attorneys
7 general, retired district attorneys, and retired assistant district attorneys, from
8 possessing and concealing a handgun on their person provided that such retired
9 justice, judge, district attorney, or assistant district attorney person is qualified
10 annually in the use of firearms by the Council on Peace Officer Standards and
11 Training and has on their person valid identification showing proof of their status as
12 a retired justice, judge, attorney general, assistant attorney general, district attorney,
13 or assistant district attorney.
14	(2)  The retired justice, judge, attorney general, assistant attorney general,
15 district attorney, or assistant district attorney shall be qualified annually in the use
16 of firearms by the Council on Peace Officer Standards and Training and have proof
17 of qualification.  However, this Subsection shall not apply to a retired justice, judge,
18 attorney general, assistant attorney general, district attorney, or assistant district
19 attorney who is medically retired based upon any mental impairment, or who has
20 entered a plea of guilty or nolo contendere to or been found guilty of a felony
21 offense.  For the purposes of this Subsection, "retired district attorney" or "retired
22 assistant district attorney" shall mean a district attorney or an assistant district
23 attorney receiving retirement benefits from the District Attorneys' Retirement
24 System.
