HOUSE BILL NO. 204

PUBLIC CONTRACT/BIDS:  Provides an exception for Jefferson Parish from certain time
limitations on submission of information with public bids
1	AN ACT
2To amend and reenact R.S. 38:2212(B)(3)(b), relative to the submission of documents to
3 Jefferson Parish as required by the Public Bid Law; to require all bidders bidding on
4 public works for Jefferson Parish to submit certain forms prior to the opening of
5 public bids; and to provide for related matters.
6	Notice of intention to introduce this Act has been published
7	as provided by Article III, Section 13 of the Constitution of
8	Louisiana.
9Be it enacted by the Legislature of Louisiana:
10 Section 1.  R.S. 38:2212(B)(3)(b) is hereby amended and reenacted to read as
11follows:
12 §2212.  Advertisement and letting to lowest responsible and responsive bidder;
13	public work; electronic bidding; participation in mentor-protégé program;

1	(b)  Notwithstanding the provisions of this Paragraph, all bidders bidding on
2 public works for East Baton Rouge Parish or Jefferson Parish shall submit all bid
3 forms required by statute or by the Louisiana Administrative Code to the governing
4 authority of East Baton Rouge Parish or Jefferson Parish prior to the opening of all
5 bids relative to a contract for public works.

Abstract: Requires all bidders bidding on public works for Jefferson Parish to submit all bid
forms required by statute or by the Louisiana Administrative Code to the governing
authority of Jefferson Parish prior to the opening of all bids relative to a contract for
public works.
Present law provides that all public work exceeding the contract limit as defined in present
law, including labor and materials, to be done by a public entity shall be advertised and let
by contract to the lowest responsible and responsive bidder who had bid according to the
bidding documents as advertised.
Proposed law retains present law.
Present law requires any public entity advertising for public work to use only the Louisiana
Uniform Bid Form.  The bidding documents can only require certain information and
documentation to be submitted by a bidder at the time designated in the advertisement for
bid opening and other information or documents are required to be submitted by the apparent
low bidder no sooner than 10 days after the date the bids are opened.
Present law provides exceptions to present law for certain entities.
Proposed law retains present law.
Proposed law requires all persons bidding on public works for Jefferson Parish to submit all
bid forms required by statute or by the Louisiana Administrative Code to the governing
authority of Jefferson Parish prior to the opening of all bids relative to a contract for public
works.
