HOUSE BILL NO. 23

RETIREMENT/MUNICIPAL EMP:  Requires the Municipal Employees' Retirement
System to establish rules and regulations governing certain procedures relative to the
election of trustees to the system board
1	AN ACT
2To amend and reenact R.S. 11:1821(H)(2), relative to the Municipal Employees' Retirement
3 System; to provide relative to procedures for the election of trustees to the system
4 board; to provide with respect to the powers and duties of the board and staff with
5 respect to such procedures; to provide with respect to the retention and certification
6 of election ballots; and to provide for related matters.
7	Notice of intention to introduce this Act has been published
8	as provided by Article X, Section 29(C) of the Constitution
9	of Louisiana.
10Be it enacted by the Legislature of Louisiana:
11 Section 1.  R.S. 11:1821(H)(2) is hereby amended and reenacted to read as follows: 
12 ยง1821.  Board of trustees; membership; term of office; oath of office; compensation;

17	(2)  Upon receipt, each ballot received by the system shall be stored and kept
18 in a secure location within the system office with access being limited to the director
19 or his designee who can certify the date of receipt of each ballot and the safeguard

1 procedures related thereto.  The board shall establish rules and regulations with
2 respect to the retention and certification of ballots received by the system.

4 Section 2.  This Act shall become effective upon signature by the governor or, if not
5signed by the governor, upon expiration of the time for bills to become law without signature
6by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.  If
7vetoed by the governor and subsequently approved by the legislature, this Act shall become
8effective on the day following such approval.

Abstract:  Requires the Municipal Employees' Retirement System (MERS) board of
trustees to establish rules and regulations with respect to certain procedures
governing trustee elections.
Present law creates the 11-member board of trustees of the MERS system.  Further provides
relative to procedures with respect to the election of trustees to the board.  Proposed law
retains present law.
Present law requires each ballot cast in a trustee election that is received by the system be
stored and kept in a secure location within the system office.  Further limits access to such
ballots to the director or his designee, who can certify the date of receipt of each ballot and
safeguard procedures related thereto.  Proposed law repeals present law and further requires
the board to establish rules and regulations with respect to the retention and certification of
ballots received by the system.
Effective upon signature of governor or lapse of time for gubernatorial action.
