HLS 16RS-806 ENGROSSED 2016 Regular Session HOUSE BILL NO. 246 BY REPRESENTATIVE ADAMS TRAFFIC/ACCIDENTS: Provides relative to an extension of the time period for coroners to report traffic fatalities 1 AN ACT 2To amend and reenact R.S. 32:398(H), relative to time periods for reporting traffic fatalities; 3 to provide for an extension of time for coroners to report fatalities; and to provide for 4 related matters. 5Be it enacted by the Legislature of Louisiana: 6 Section 1. R.S. 32:398(H) is hereby amended and reenacted to read as follows: 7 ยง398. Accident reports; when and to whom made; information aid; fees for copies; 8 fees for accident photographs 9 * * * 10 H. Every person holding the office of coroner in this state, or, in the event 11 of a vacancy in the office, the person performing the duties of coroner, shall report 12 to the Department of Public Safety and Corrections and to the Louisiana Highway 13 Safety Commission the death of any person as a result of an accident a collision 14 involving a motor vehicle, and the circumstances of the accident collision within five 15 sixty days following such death. Such reports shall be made on forms supplied or 16 approved by the department as provided for in Subsection I of this Section. [R.S. 1:13(B) and 24:177(E)] HB 246 Engrossed 2016 Regular Session Adams Abstract: Provides an extension for coroners to report to the Department of Public Safety and Corrections and to the Louisiana Highway Safety Commission the death of any person as a result of a collision involving a motor vehicle and the circumstances surrounding it. Present law requires a coroner to present a report within five days to the Dept. of Public Safety and Corrections and to the La. Hwy. Safety Commission regarding the death of any person as a result of an accident involving a motor vehicle and the circumstances surrounding it. Proposed law modifies present law by increasing the time period for reporting from five days to 60 days. Also, modifies present law by replacing the word "accident" with "collision". Present law requires every hospital to notify the coroner of the parish in which it is located of any death occurring in the hospital as a result of injuries sustained in a motor vehicle accident. Proposed law repeals the present law notification requirement.
