ENROLLED ACT No. 105 2016 Regular Session HOUSE BILL NO. 252 BY REPRESENTATIVE DAVIS 1 AN ACT 2 To enact R.S. 37:36(E)(1)(aa) and (3), relative to provisional licenses for ex-offenders; to 3 exempt the Louisiana Licensed Professional Counselors Board of Examiners from 4 certain provisions relative to the issuance of provisional licenses to ex-offenders; to 5 require certain record keeping of certain licensing entities; to require certain annual 6 reports; and to provide for related matters. 7 Be it enacted by the Legislature of Louisiana: 8 Section 1. R.S. 37:36(E)(1)(aa) and (3) are hereby enacted to read as follows: 9 ยง36. Exemptions; prohibitions; records; reports 10 * * * 11 E.(1) This Chapter shall not apply to the following licensing entities: 12 * * * 13 (aa) The Louisiana Licensed Professional Counselors Board of Examiners. 14 * * * 15 (3)(a) A licensing entity exempt from the provisions of this Chapter shall 16 keep record and compile a report of the number of provisional licenses denied by the 17 entity, including all reasons for such denial, when the denial is of an otherwise 18 qualified applicant who has been convicted of an offense or offenses, except those 19 described in Subsections A through C of this Section. 20 (b) Notwithstanding the exemption of licensing entities as provided in this 21 Section, any licensing entity issuing provisional licenses in accordance with this Page 1 of 2 CODING: Words in struck through type are deletions from existing law; words underscored are additions.
