HOUSE BILL NO. 272

ETHICS:  Allows a public servant to accept complimentary admission to a fundraising event
held by or for the benefit of certain educational institutions or programs, excluding
professional, semi-professional, or collegiate sporting events
1	AN ACT
2To enact R.S. 42:1123(13)(a)(iii), relative to the acceptance of complimentary admission by
3 public servants; to allow the acceptance of complimentary admission to certain
4 events held for or by educational institutions and other organizations; and to provide
5 for related matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 42:1123(13)(a)(iii) is hereby enacted to read as follows: 
8 §1123.  Exceptions
9	This Part shall not preclude:

13	(iii)  The acceptance by a public servant of complimentary admission to a
14 fundraising event held by or for the benefit of an educational institution or by or for
15 the benefit of a nonprofit organization which conducts educational programs.

17 Section 2.  This Act shall become effective upon signature by the governor or, if not
18signed by the governor, upon expiration of the time for bills to become law without signature
19by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.  If

1vetoed by the governor and subsequently approved by the legislature, this Act shall become
2effective on the day following such approval.

Abstract:  Allows a public servant to accept complimentary admission to a fundraising
event held by or for the benefit of an educational institution or a nonprofit
organization which conducts educational programs, excluding professional, semi-
professional, or collegiate sporting events.
Present law   (R.S. 42:1111 and 1115 – ethics code) generally prohibits public servants from
receiving things of economic value from specified prohibited sources or for certain duties
related to the public position.   Present law provides certain exceptions, including allowing
a public servant to accept complimentary admission to a civic, non-profit, educational, or
political event when the public servant is a program honoree, giving a speech at the event,
or a panel member for a discussion occurring at the event and allowing a public servant to
accept complimentary admission to a fundraising event for a candidate or political party. 
Present law specifically excludes from such exceptions admission to any professional, semi-
professional, or collegiate sporting event.
  
Proposed law additionally provides an exception to allow a public servant to accept
complimentary admission to a fundraising event held by or for the benefit of an educational
institution or by or for the benefit of a nonprofit organization which conducts educational
programs.  Proposed law maintains the exclusion from such exception admission to any
professional, semi-professional, or collegiate sporting event.
Effective upon signature of governor or lapse of time for gubernatorial action.
