ENROLLED ACT No. 46 2016 Regular Session HOUSE BILL NO. 323 BY REPRESENTATIVE JACKSON 1 AN ACT 2 To authorize and provide for the transfer of certain state property; to authorize the transfer 3 of certain state property in Morehouse Parish; to provide for the property description; 4 to provide for reservation of mineral rights; to provide terms and conditions; to 5 provide an effective date; and to provide for related matters. 6 Be it enacted by the Legislature of Louisiana: 7 Section 1. The secretary of the Department of Wildlife and Fisheries, 8 notwithstanding any other provision of law to the contrary, is hereby authorized and 9 empowered to convey, transfer, assign, lease, or deliver any interest, excluding mineral 10 rights, the state may have to all or any portion of the following described parcel of property 11 to Kenneth W. Cook, Jr., and Annie S. Cook: 12 A certain tract of property located in Section 36, Township 20 North, Range 5 East, 13 in Morehouse Parish, Louisiana and more particularly described as follows: 14 Beginning at the Southwest corner of Section 36, Township 20 North, Range 5 East, 15 then run East 1380 feet to a point, then North 59 Degrees, 17 Minutes, West 1600 16 feet to a point, then South 800 feet to the point of the beginning, containing 17 approximately 12.60 acres. 18 Section 2. The secretary of the Department of Wildlife and Fisheries is hereby 19 authorized to enter into such agreements, covenants, conditions, and stipulations and to 20 execute such documents as necessary to properly effectuate any conveyance, transfer, 21 assignment, lease, or delivery of title, excluding mineral rights, to the property described in 22 Section 1 of this Act, and as more specifically described in any such agreements entered into 23 and documents executed by and between the secretary of the Department of Wildlife and 24 Fisheries and Kenneth W. Cook, Jr., and Annie S. Cook, in exchange of consideration 25 proportionate to the appraised value of the property. Page 1 of 2 HB NO. 323 ENROLLED 1 Section 3. This Act shall become effective upon signature by the governor or, if not 2 signed by the governor, upon expiration of the time for bills to become law without signature 3 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If 4 vetoed by the governor and subsequently approved by the legislature, this Act shall become 5 effective on the day following such approval.
