HOUSE BILL NO. 335

AGRICULTURE:  Provides for the establishment of an unmanned aerial system registration
and licensing fees
1	AN ACT
2To amend and reenact R.S. 3:43(A)(2) and to enact R.S. 3:48, relative to registration fees for
3 unmanned aerial systems; to establish a registration fee for unmanned aerial systems;
4 and to provide for related matters.
5Be it enacted by the Legislature of Louisiana:
6 Section 1.  R.S. 3:43(A)(2) is hereby amended and reenacted and R.S. 3:48 is hereby
7enacted to read as follows:
8 §43.  Licenses and registration
9	A.  Each person operating an unmanned aerial system in the course of an
10 agricultural commercial operation shall obtain a license from the department, which
11 shall be issued upon the applicant meeting the following requirements:

13	(2)  Prior to applying for a license, each applicant shall complete an
14 agricultural education and safety training course administered by the Louisiana
15 cooperative extension service or the Southern University Agricultural Research and
16 Extension Center and comply with any other licensing requirements established by
17 the commissioner by rule.

1 §48.  Fees
2	A.  The commissioner shall establish, by rule in accordance with the
3 Administrative Procedure Act, a registration fee for an unmanned aerial system in
4 an amount not to exceed one hundred dollars.
5	B.  The commissioner shall establish, by rule in accordance with the
6 Administrative Procedure Act, a licensing fee payable to the Louisiana State
7 University Agricultural Center or the Southern University Agricultural Research and
8 Extension Center, not to exceed fifty dollars for conducting the agricultural
9 education and safety training course as required by R.S. 3:43(A)(2).

Abstract: Establishes registration and licensing fees related to unmanned aerial systems.
Present law requires each applicant applying for a license to operate an unmanned aerial
system in the course of an agricultural commercial operation to complete an agricultural
education and safety training course administered by the Louisiana cooperative extension
service.
Proposed law adds Southern University Agricultural Research and Extension Center as an
entity that may administer the agricultural education and safety training course.
Proposed law authorizes the commissioner to establish, by rule, a registration fee for
unmanned aerial systems not to exceed $100.  Requires the rule be adopted in accordance
with the Administrative Procedure Act (APA).
Proposed law authorizes the commissioner to establish a licensing fee not to exceed $50,
payable to the La. State University Agricultural Center or the Southern University
Agricultural Research and Extension Center for conducting the agricultural education and
safety training course required in present law.  Requires the rule be adopted in accordance
with the APA.

1. Authorize the commissioner to establish a licensing fee not to exceed $50,

The House Floor Amendments to the engrossed bill:
1. Decrease the proposed registration fee from $500 to $100.
2. Add Southern University Agricultural Research and Extension Center to the
entities that may administer an agricultural education and safety training course
and receive payment for administering the course.
