HOUSE BILL NO. 34

RETIREMENT/MUNICIPAL EMP:  Provides that all mayors are members of the Municipal
Employees' Retirement System
1	AN ACT
2To amend and reenact R.S. 11:1732(13)(a), relative to membership in the Municipal
3 Employees' Retirement System; to provide that all mayors are members of the
4 system; and to provide for related matters.
5	Notice of intention to introduce this Act has been published
6	as provided by Article X, Section 29(C) of the Constitution
7	of Louisiana.
8Be it enacted by the Legislature of Louisiana:
9 Section 1.  R.S. 11:1732(13)(a) is hereby amended and reenacted to read as follows:
10 ยง1732.  Definitions
11	The following words and phrases, as used in this Chapter, unless a different
12 meaning is plainly required by the context, shall have the following meaning:

14	(13)(a)  "Employee" means a person, including an elected official, actively
15 employed by a participating employer on a permanent, regularly scheduled basis of
16 at least an average of thirty-five hours per week and any municipal mayor whether
17 elected or appointed and regardless of his work schedule.

1 Section 2.  This Act shall become effective on July 1, 2016; if vetoed by the governor
2and subsequently approved by the legislature, this Act shall become effective on July 1,
32016, or on the day following such approval by the legislature, whichever is later.

Abstract:  Provides that any municipal mayor, whether appointed or elected and regardless
of work schedule, is in the Municipal Employees' Retirement System (MERS).
Present law creates and provides for MERS.  Defines employee for purposes of applicability
of the retirement system as a person, including an elected official, actively employed by a
municipality or other specified entities on a permanent, regularly scheduled basis of at least
35 hours per week.
Proposed law retains present law and additionally provides that any municipal mayor,
whether appointed or elected and regardless of work schedule, is an employee covered by
MERS.
