HOUSE BILL NO. 343

SCHOOLS/BOARDS:  Provides relative to the composition of the St. Mary Parish School
Board and to the election of its members
1	AN ACT
2To enact R.S. 17:52.3, relative to the St. Mary Parish School Board; to provide relative to
3 the composition of the school board; to provide relative to the election of school
4 board members; to provide relative to election districts; to provide relative to terms;
5 to provide relative to effectiveness; and to provide for related matters.
6	Notice of intention to introduce this Act has been published
7	as provided by Article III, Section 13 of the Constitution of
8	Louisiana.
9Be it enacted by the Legislature of Louisiana:
10 Section 1.  17:52.3 is hereby enacted to read as follows:
11 ยง52.3.  St. Mary Parish School Board; election of members; composition; election
12	districts
13	A. Notwithstanding the provisions of R.S. 17:52 and any other provision of
14 law to the contrary, members of the St. Mary Parish School Board shall be elected
15 at the gubernatorial elections.
16	B.  (1) The St. Mary Parish School Board shall have the same number of
17 members as the St. Mary Parish Council.
18	(2) The members of the St. Mary Parish School Board shall be elected from
19 the election districts of the St. Mary Parish Council.

1 Section 2.  To facilitate moving the election of members of the St. Mary Parish
2School Board from the congressional elections to the gubernatorial elections, the terms of
3members of the St. Mary Parish School Board elected at the congressional elections in 2014
4are five-year terms.
5 Section 3. (A) This Act shall take effect and become operative if and when the
6proposed amendment of Article VIII of the Constitution of Louisiana contained in the Act
7which originated as House Bill No. ___ of this 2016 Regular Session of the Legislature is
8adopted at a statewide election and becomes effective, except as provided in Subsection (B)
9of this Section.
10 (B)  If the constitutional amendment is adopted and becomes effective, the provisions
11of Section 1 of this Act shall become effective on January 1, 2020, except that for purposes
12of qualifying and election of members to the St. Mary Parish School Board at the 2019
13gubernatorial elections, the provisions of Section 1 of this Act shall become effective as
14provided in Subsection (A) of this Section.

Abstract:  Provides relative to the composition of the St. Mary School Board and for the
election and election districts of its members.
Present law (R.S. 17:52) provides for parish school board members to be elected at the
congressional elections. Proposed law provides, that notwithstanding present law, members
of the St. Mary Parish School Board shall be elected at the gubernatorial elections; the
school board shall have the same number of members as the St. Mary Parish Council; school
board members shall be elected from the parish council election districts; and, to facilitate
moving this school board's election from the congressional to the gubernatorial elections,
school board members elected in 2014 shall serve five-year terms.
Effective, in part, if and when the proposed amendment of Article VIII of the Constitution
of La. contained in the Act which originated as House Bill No. ___ of this 2016 R.S. of the
Legislature is adopted at a statewide election and becomes effective. Effective, in part, on
January 1, 2020.
