COURTS/CITY:  Extends the territorial jurisdiction of the City Court of the town of
Franklin
1	AN ACT
2To amend and reenact R.S. 13:2488.1(A), relative to the City Court of the town of Franklin;
3 to provide relative to the territorial jurisdiction of the court; and to provide for
4 related matters.
5Be it enacted by the Legislature of Louisiana:
6 Section 1.  R.S. 13:2488.1(A) is hereby amended and reenacted to read as follows: 
7 ยง2488.1.  City Court of Franklin; officials and employees; provisions governing 
8	A.(1)  Effective September 1, 1968 the offices of the justice of the peace and
9 constable in Ward Three of St. Mary Parish, Louisiana, and the Mayor's Court in the
10 town of Franklin, St. Mary Parish, Louisiana, are abolished and there is hereby
11 established and created a court to be styled the City Court of the town of Franklin,
12 Louisiana, the.
13	(2)(a)  The territorial jurisdiction of which the court shall extend throughout
14 the town of Franklin, Louisiana and throughout the whole of Ward Three of St. Mary
15 Parish, Louisiana.
16	(b)  In addition to the area provided in Subparagraph (a) of this Paragraph,
17 the territorial jurisdiction of the court shall extend throughout the portions of Ward
18 Ten of St. Mary Parish that are east of the Charenton Drainage and Navigation Canal
19 and south of Bayou Teche.  In such portions of Ward Ten that are outside of the town

1 of Franklin, the court shall have jurisdiction concurrent with the justice of the peace
2 in those cases in which the justice of the peace would have jurisdiction.
3	(3)  The court shall be composed of a city judge, a marshal and a clerk of said
4 the court.  The offices of city judge and marshal shall be filled initially by election
5 by the qualified electors of Ward Three of St. Mary Parish, Louisiana at the general
6 election for Representatives in Congress to be held in Louisiana on the first Tuesday
7 next following the first Monday in November, 1968.  The city judge and marshal
8 then elected shall serve a term to commence on January 1, 1969 and they shall serve
9 until their successors are elected at the congressional election of 1972, and successor
10 judges and marshals shall be elected at the congressional election every six years
11 thereafter.  The court shall be domiciled in Franklin, St. Mary Parish, Louisiana.

Abstract: Increases the territorial jurisdiction of the City Court of the town of Franklin.
Present law provides for the territorial jurisdiction of the City Court of the town of Franklin. 
Provides that the territorial jurisdiction of the court extends throughout the town of Franklin
and throughout the whole of Ward Three of St. Mary Parish.
Proposed law retains present law and additionally provides that the territorial jurisdiction of
the court extends throughout the portions of Ward Ten of St. Mary Parish that are east of the
Charenton Drainage and Navigation Canal and south of Bayou Teche.  Provides further that
in such portions of Ward Ten that are outside of the town of Franklin, the court shall have
jurisdiction concurrent with the justice of the peace in those cases in which the justice of the
peace would have jurisdiction.
