RÉSUMÉ DIGEST ACT 408 (HB 454) 2016 Regular Session Richard Existing law for FY 2015-2016 through FY 2017-2018, establishes a process for all professional, personal, and consulting services contracts totaling $40,000 or more per year to be reported, reviewed, and approved by the JLCB. Prior law limited the reporting, reviewing, and approval of the contracts to those that were funded solely from state general fund (direct) or from the Overcollections Fund and were for discretionary purposes. New law removes requirements that the contracts be funded solely from state general fund (direct) or from the Overcollections Fund and are for discretionary purposes. Existing law provides a process for the review and action of JLCB regarding reported contracts, including approval, rejection, or recommended revisions to the contract. New law adds social services contracts to the types of contracts to be reported, reviewed, and approved by JLCB. Existing law provides for a periodic determination by the commissioner of administration of monies appropriated for professional, personal, and consulting service contracts that remain unexpended as a result of contracts that are not approved by JLCB. Further, requires the commissioner of administration to report these monies to the treasurer. These monies are available for deposit into the Higher Education Financing Fund. New law includes social service contracts to the types of contracts subject to periodic determination by the commissioner of unexpended monies as a result of contracts that are not approved by JLCB. Existing law provides exceptions for certain professional, personal, or consulting service contracts. New law includes social service contracts in the exceptions.
