HOUSE BILL NO. 459

REGISTRARS OF VOTERS:  (Constitutional Amendment) Provides that the manner of
appointment and qualifications of the registrar are to be provided by law
1	A JOINT RESOLUTION
2Proposing to amend Article XI, Section 5 of the Constitution of Louisiana, to provide
3 relative to registrars of voters; to provide that the manner of appointment of
4 registrars is as provided by law; to require the qualifications for registrars to be
5 provided by law; to provide for submission of the proposed amendment to the
6 electors; and to provide for related matters.
7 Section 1.  Be it resolved by the Legislature of Louisiana, two-thirds of the members
8elected to each house concurring, that there shall be submitted to the electors of the state of
9Louisiana, for their approval or rejection in the manner provided by law, a proposal to
10amend Article XI, Section 5 of the Constitution of Louisiana, to read as follows:
11 §5.  Registrar of Voters 
12	Section 5.  The governing authority of each parish shall appoint a registrar
13 of voters, whose in the manner provided by law.  The compensation, removal from
14 office for cause, bond, powers, qualifications, and functions of the registrar shall be
15 provided by law.  Upon qualifying as a candidate for other public office, a registrar
16 shall forfeit his office.  No law shall provide for the removal from office of a
17 registrar by the appointing authority.
18 Section 2.  Be it further resolved that this proposed amendment shall be submitted
19to the electors of the state of Louisiana at the statewide election to be held on November 8,

1 Section 3.  Be it further resolved that on the official ballot to be used at the election,
2there shall be printed a proposition, upon which the electors of the state shall be permitted
3to vote YES or NO, to amend the Constitution of Louisiana, which proposition shall read as
4follows:
5	Do you support an amendment to provide that the manner of appointment for
6	the registrar of voters in each parish is as provided by law and to require the
7	qualifications of the registrar to be provided by law? (Amends Article XI,
8	Section 5)

Abstract:  Provides that the manner of appointment for the registrar of voters is as provided
by law and to require the qualifications of the registrar to be provided by law.
Present constitution (Art. XI, §5) provides that the governing authority of each parish shall
appoint a registrar of voters, whose compensation, removal from office for cause, bond,
powers, and functions shall be provided by law.  Provides that upon qualifying as a
candidate for other public office, a registrar shall forfeit his office.  Provides further that no
law shall provide for the removal from office of a registrar by the appointing authority.
Proposed constitutional amendment retains present constitution.  Provides that the manner
of appointment of the registrar is as provided by law.  In addition, requires the qualifications
of the registrar to be provided by law.
Provides for submission of the proposed amendment to the voters at the statewide election
to be held Nov. 8, 2016.
