R.S. 30:560(B) and (C) and 706 are hereby amended and reenacted and 8R.S. 30:560(D) is hereby enacted to read as follows: 9 §560. Pipeline safety inspection fees 10 * * * 11 B. There is hereby imposed upon all distributors of jurisdictional gas which 12 own and operate any jurisdictional gas distribution system which comes under the 13 supervision of the assistant secretary pursuant to R.S. 30:551(B) an annual safety and 14 odorization inspection fee not to exceed twenty-two dollars and forty cents per mile 15 of pipeline used in a jurisdictional gas distribution system one dollar per service line, 16 or four hundred dollars per pipeline facility, whichever is greater. The commissioner 17 shall annually review the fee amount and may revise it in accordance with the 18 Administrative Procedure Act. 19 C. The commissioner shall annually review the 3 fee amount and may revise it in accordance with the Administrative Procedure Act. 4 D. The annual inspection fees imposed by this Section are for the purpose 5 of enforcing the natural gas pipeline safety standards and practice required by this 6 Chapter and regulations promulgated thereunder. All fees collected by the 7 commissioner shall be reasonably related to the services provided and shall be used 8 by the office of conservation solely for the purposes of that program. 9 * * * 10 §706. Fees 11 In order to implement this Part, every person engaged in the transportation 12 of hazardous liquids or who owns or operates intrastate pipeline facilities for the 13 transportation of hazardous liquids shall be assessed an annual fee which shall not 14 exceed twenty-two dollars and forty cents forty-four dollars and eighty cents for each 15 mile or fraction thereof of pipeline operated or four eight hundred dollars per 16 pipeline facility, whichever is greater. The commissioner shall annually review the 17 fee amount and may revise it not to exceed twenty-two dollars and forty cents forty- 18 four dollars and eighty cents per mile in accordance with the Administrative 19 Procedure Act. All fees collected by the commissioner shall be reasonably related 20 to the services provided and shall be used by the office of conservation solely for the 21 purposes of that program. Proposed law retains the present law alternative fee of $400 per pipeline facility, whichever is greater. Proposed law provides an annual safety inspection fee not to exceed $44.80 per mile of pipeline used in a jurisdictional gas pipeline system, or $800 per pipeline facility, whichever is greater, imposed on all distributors of jurisdictional gas which own or operate any jurisdictional gas gathering or transmission system. Specifies that the fee is subject to annual review by the commissioner of conservation. Present law establishes an annual inspection fee on hazardous liquid pipelines to fund safety regulations of such pipelines. Specifies that the maximum fee is $22.40 per mile of pipeline or $400 per pipeline facility, whichever is greater. Provides that the fee is subject to annual review by the commissioner of conservation. Requires the commissioner to annually review the fee amount and authorizes the commissioner to revise it up to $22.40. Proposed law increases the fee from not to exceed $22.40 per mile or $400 per pipeline facility, whichever is greater to not to exceed $44.80 per mile or $800 per pipeline facility, whichever is greater. Increases the commissioner's authorization to revise the fee from not to exceed $22.40 to not to exceed $44.80.
