HLS 16RS-859 ORIGINAL 2016 Regular Session HOUSE BILL NO. 481 BY REPRESENTATIVE JAMES MTR VEHICLE/DRIVER LIC: Provides relative to the issuance and possession of drivers' licenses 1 AN ACT 2To amend and reenact R.S. 32:411(F)(1) and 412(D)(6), relative to the issuance and 3 possession of drivers' licenses; to provide for the issuance of an electronic copy of 4 a driver's license; to provide new requirements for the issuance of a driver's license 5 that was renewed by mail or electronic commerce; and to provide for related matters. 6Be it enacted by the Legislature of Louisiana: 7 Section 1. R.S. 32:411(F)(1) and 412(D)(6) are hereby amended and reenacted to 8read as follows: 9 §411. Deposit of license in lieu of security upon arrest; receipt; licensee to have 10 license or receipt in immediate possession; notification to vehicle owner; 11 surrender of license; issuance of temporary permits 12 * * * 13 F.(1) The licensee shall have his license, or an electronic copy of the license 14 provided by the Department of Public Safety and Corrections, office of motor 15 vehicles, in his immediate possession at all times when driving a motor vehicle and 16 shall display it upon demand of any officer or agent of the department or any police 17 officer of the state, parish, or municipality, except that where the licensee has 18 previously deposited his license as provided in Subsection C of this Section, and has 19 received a receipt, as provided in Subsection D of this Section, the licensee shall 20 display the receipt upon demand of any officer or agent of the department or any Page 1 of 3 CODING: Words in struck through type are deletions from existing law; words underscored are additions. HLS 16RS-859 ORIGINAL HB NO. 481 1 police officer of the state, parish, or municipality, the same to serve as a substitute 2 for the license until the license is returned to the licensee. However, when an officer 3 or agent of the department or any police officer of the state, or any parish or 4 municipality has reasonable grounds to believe a person has committed an offense 5 of driving without a valid driver's license in his possession, the police officer shall 6 make every practical attempt based on identifying information provided by the 7 person to confirm that the person has been issued a valid driver's license. If the 8 police officer determines that the person has been issued a valid driver's license 9 which is neither under revocation, suspension, or cancellation, but that the license 10 is not in his possession, the peace officer shall issue a written summons to the 11 offender in accordance with law, commanding him to appear and answer the charge. 12 * * * 13 §412. Amount of fees; credit or refund; duration of license; veteran designation; 14 university logo; "I'm a Cajun" designation; disbursement of funds; renewal 15 by mail or electronic commerce of Class "D" or "E" drivers' licenses; 16 disposition of certain fees; exception 17 * * * 18 D.(1) Upon application and payment of the fee imposed by this Chapter and 19 subject to the requirements of R.S. 32:408, a license shall be renewable on or before 20 its expiration. An application for renewal may be made at any time within one 21 hundred eighty days prior to expiration unless the renewal is otherwise restricted by 22 the department. 23 * * * 24 (6) When a license is renewed by mail or electronic commerce, the secretary 25 shall issue a new license which indicates the new expiration date evidence of renewal 26 which shall be affixed to the previously issued license to indicate the date the license 27 expires in the future. 28 * * * Page 2 of 3 CODING: Words in struck through type are deletions from existing law; words underscored are additions. Present law requires that a licensee have his license in his immediate possession at all times when driving a motor vehicle. Proposed law modifies present law by authorizing a licensee to have an electronic copy of his license provided by the Dept. of Public Safety and Corrections, office of motor vehicles, as an alternative to his physical license. Present law requires the secretary of the Dept. of Public Safety and Corrections to issue evidence of renewal of Class "D" or "E" drivers' licenses to be affixed to the previously issued license to indicate the date the license expires in the future when a license is renewed by mail or electronic commerce. Proposed law modifies present law by requiring the secretary to issue a new license which indicates the new expiration date when a license is renewed by mail or electronic commerce.
