HOUSE BILL NO. 485

CHILDREN/SUPPORT:  Provides for access to consumer reports by the Department of
Children and Family Services for child support purposes
1	AN ACT
2To amend and reenact R.S. 46:236.1.10(A), relative to child support enforcement; to provide
3 relative to establishing capacity to make child support payments or establishing the
4 level of such payments; to provide relative to accessing credit reports; and to provide
5 for related matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 46:236.1.10(A) is hereby amended and reenacted to read as follows: 
8 ยง236.1.10.  Family and child support programs; consumer reporting authority
9	A.  Any consumer reporting agency, as defined in R.S. 46:56(M)(2), shall
10 provide a consumer report to the secretary or his designee, provided the department
11 pays a fee to the consumer reporting agency and certifies all of the following:
12	(1)  The consumer report is needed for the purpose of establishing an
13 individual's capacity to make child support payments or for the determination of the
14 appropriate level of such payments.
15	(2)  The paternity of the individual for the child to which the obligation
16 relates has been established or acknowledged by the individual in accordance with
17 state law.
18	(3)  The requestor has provided at least ten days notice of the request by
19 certified or registered mail to the individual at his last known address.

Abstract:  For purposes of child support obligations, deletes requirement that written
notification be given prior to obtaining a credit report. 
Present law requires the DCFS to notify an individual in writing 10 days prior to requesting
that individual's credit report for purposes of establishing that individual's capacity to make
child support payments. 
Proposed law eliminates the requirement that the DCFS notify an individual in writing 10
days prior to requesting that individual's credit report with regard to child support payments.
