ACT 29 (HB 485) 2016 Regular Session Robert Johnson
Prior law authorized the secretary of the Dept. of Children and Family Services (DCFS) or
his designee to receive a consumer credit report from any consumer reporting agency if the
department pays a fee to the agency and certifies all of the following:
(1)The report is needed for the purpose of establishing an individual's capacity to make
child support payments or for the determination of the appropriate level of such
payments.
(2)The paternity of the individual for the child to which the obligation relates has been
established or acknowledged by the individual in accordance with state law.
(3)The requestor has provided at least 10 days notice of the request by certified or
registered mail to the individual at his last known address.
New law eliminates the requirement for DCFS to notify an individual in writing 10 days
prior to requesting that individual's consumer credit report with regard to child support
payments.
Effective August 1, 2016.
